Yes, registration is required for protection of an industrial design in Malaysia.
Your design will not be automatically protected by the industrial design legislation without registration. Therefore, an unregistered industrial design will not be protected.
The applicant of a registered industrial design will be issued a certificate of registration. The certificate of registration shall be
prima facie evidence of the facts stated therein and of the validity of the registration.
The Intellectual Property Corporation of Malaysia (MyIPO) (Malay:
Perbadanan Harta Intelek Malaysia) 1 will then cause to be published in the Government Gazette:
- a notice that the industrial design has been registered;
- the name and address of the registered owner; and
- any other matters constituting or relating to the industrial design which in his opinion it is desirable to publish.
