What should the Joint Affidavit by Petitioners in Support of Petition look like?

An affidavit must be sworn or affirmed before a Commissioner for Oaths and is considered as an evidence in court proceedings.

  1. Answer the questions carefully. You cannot make changes to an affidavit that has already been filed.

  2. The court may in its discretion reject any affidavit the content of which cannot be easily read or understood, scandalous, irrelevant or otherwise oppressive.

  3. All questions must be answered. Make all attempts to find the answer. If you think that a question does not apply to you, please indicate so.

  4. Use short sentences wherever possible.

  5. All paragraphs must be numbered consecutively.

  6. Your full name, full residential address and occupation must be stated in the affidavit.

  7. Dates, sums and other numbers must be expressed in figures, not in words.

  8. Content of an affidavit can only be facts as you are able of your own knowledge to prove.
