What is the information required by Form 4 of the Divorce and Matrimonial Proceedings Rules 1980 (Statement as to Arrangement for Children)?

If you have any children under 16 or who are over the age and are at school, college or university or are training for a trade, profession or vocation, your divorce petition must be accompanied by a separate written statement containing the information required by Form 4 Statement as to Arrangement for Children.

You should try to reach an agreement with your spouse over the proposals for the children's future. If your spouse does not agree with all or some of the arrangements or proposals, he or she will have the opportunity to explain reasons for disagreement and to make his or her own proposals.

For High Court in Kuala Lumpur, you need to state the division of the court. Insert (FAMILY COURT, CIVIL DIVISION) one line below the county of court.

Leave the Divorce Petition Number blank. When you file your divorce petition, you will be assigned a case number, which must be marked on all subsequently filed documents.

  1. The present arrangements for the minor children of the family under 16 and those over 16 who are receiving instruction at an educational establishment or undergoing training for a trade, profession or vocation are as follows:

    State in respect of each child -
    1. residence [state where the child is living, particulars of the accommodation, what other persons (naming them) live there and who looks after the child].

    2. education [state the name of the school or other educational establishment which the child is attending or, if he is working, his place of employment, the nature of his work and details of any training he is receiving].

    3. financial provision [state who is supporting the child or contributing to his support and the extent thereof].

    4. access [state any arrangements which have been agreed for access by either of the parties and the extent to which access is and has been afforded].
