Suruhanjaya Pelantikan Kehakiman (SPK)

Known as the Judicial Appointments Commission (JAC) in English.

The Judicial Appointments Commission (JAC) was established in February, 2009 under the Judicial Appointments Act 2009 [Act 695]. In accordance with the provisions of Act 695, "the main role of the Commission is to uphold/the Commission has been tasked with upholding" the continuous independence of the judiciary through the selection of superior court judges.

The functions of the Judicial Appointments Commission (JAC) are :-
  • to select suitably qualified persons who merit appointment as judges of the superior court for the Prime Minister's consideration;
  • to receive applications from qualified persons for the selection of judges to the superior court;
  • to formulate and implement mechanisms for the selection and appointment of judges of the superior court;
  • to review and recommend programs to the Prime Minister to improve the administration of justice;
  • to make other recommendations about the judiciary; and
  • to do such other things as it deems fit to enable it to perform its functions effectively or which are incidental to the performance of its functions under the Act.

A candidate is qualified for selection if he fulfills the requirement under Article 123 of the Federal Constitution.

The Commission shall take into account amongst others, the following selection criteria :
  • integrity, competency and experience;
  • objective, impartial, fair and good moral character;
  • decisiveness, ability to make timely judgments and good legal writing skills;
  • industriousness and ability to manage cases well and;
  • physical and mental health.

A person who is a serving judge or judicial commissioner must not be appointed if he has three or more pending judgments or unwritten grounds of judgments that are overdue by sixty days or more from the date they are deemed to be due.

The need to encourage diversity in the range of legal expertise and knowledge in the judiciary must also take into account.
