LAW IN SOUTH AFRICA
The law of South Africa is based on an amalgam of English common law, Roman-Dutch civil law and Customary law.
The Constitutional Court is the highest court in all constitutional matters while the Supreme Court of Appeal is the highest court in respect of all matters other than constitutional ones in South Africa.
The legal profession in South Africa is divided into Advocates and Attorneys. Dual practice is not permitted.
Attorneys are registered with four provincial law societies, which are coordinated and represented by the Law Society of South Africa. An attorney is engaged directly by a client, who then engages the service of an advocate. Therefore, an advocate is also known as a referral profession. Advocates are represented and regulated by a federal body called the General Council of the Bar of South Africa.
