Penjamin tiba-tiba terima panggilan nak sita rumah untuk membayar bank hutang pinjaman 16 tahun lalu

Saya merupakan penjamin 16 tahun yang lalu. Sekarang peminjam sudah lari dan saya dikejar oleh bank rakyat. Masalahnya dalam tempoh 16 tahun saya tak pernah di beri notis oleh bank. Tiba-tiba satu panggilan menakutkan suruh saya bayar RM20 ribu sekarang jika tidak mereka nak sita rumah.

May Lord Buddha Bless You Too. You just a guarrantor only. Bank rakyat or their appointed bill collectors can still try to call you to pay. Just ignore their calls. No further court actions. Do not pay even RM10. Any legal court action da "lupus"........ expired...

Ada itu Pak Dolah. Cik Aurora cakap bank boleh tuntut hutang lagi walaupun dah tamat tempoh. Dia reply saya di thread Pak Dolah bagi di atas.

Aurora case not the same. Hers is credit card and under her own name. She is fighting against a Judgement in Default. Yours is a loan which requires a quarantor and you are the one.
Loose no sleep. The bank and or their bill collectors can still try to chase for this debt but no further legal in court can be taken. So no sita rumah or bankruptcy.

The procedure for loans with guarantor is like this.

Let's say your friend name is Ali. Ali took a loan and you are the gurantor. This is a secured loan. Credit cards are unsecured loans. When Ali default on his payments to the bank, within 6 months they become NPL (Non Performing Loans) and the bank will write letters to Ali and the guarantor for immediate repayment of loans. They have to write two Letters of Demands, one to Ali, one to the guarantor (you). If no replies from the two letters, file in court for Judgement debt naming Ali and you as co-defendants.

Once they get a Judgement Debt, the next step is to get another court order for WSS (sita barang barang dari rumah). The last step is to file for bankruptcy if the amount is >30K. Also two name will have to be filed but file individually. The costs to file a bankruptcy can be as high as 8K per person. For two persons is 16K. Take out cash 16K to chase for 20K? Hahahaa, hanya orgorg gila buat begitu...

Since the bank bill collectors is chasing you for 20K, and you have not receive any letters of demand, Judgement Debt summons, means no further action by way of court orders.

A debt is a debt. They are allow by law to try chase you for the debts. Scare you, intimidate you by telephone calls, that is their "dirty" tactics. Cannot apply court order to sita barang barang, kereta. Hanya mau "sita roh" shj. Jangan takut atas tactics lucur mereka. Have any of them go to your house to see you? Do not open the door or talk to them. Ask to show a court order, no photostat copy, a court Baliff would have to be will them. Even if there is a court baliff or real court order, they cannot remove any things. They can only lists down the valuable items. They will give you a date to attend court to "pay' or "dispute" the court order. They wont carry your bed away.

Do not worry, if what information you have given in your post is accurate.... SLEEP WELL.. Da "lupus"..

Note I wrote. Any further court action sudah "lupus" by applying the 6 years Limitation Act. A debt is a debt, Hutang TAK "lupus".

Maklumat yang saya kongsikan berdasarkan kes-kes di Malaysia. Memang betul kata Pak Dollah dan vkpc. Sepatutnya apabila hutang telah lupus had masanya, begitu jugalah jaminan yang terikat kepada hutang tersebut.
