Condition for Court of Appeal

Anyone know if the bankruptcy case is less then RM250K, can I appeal to the "Court of Appeal"?

For appeal against bankruptcy itself, any amount ( even if less than RM 250k ) can be appealed without requiring any leave ( permission ).
Just file the Notice of Appeal.  ( Notis Rayuan )

Thank you so much notalawyer.

I'll file in the "Notis Rayuan" and start preparing for "Rekod Rayuan" later.

My case is the other party lawyer didn't turn up during "Bankruptcy Notice" decision day, then PKP let me win, but they appeal to judge in chambers and the judge allowed their appeal.

I'm also filing in "Stay of Execution" with "Afidavit" pending the appeal to court of appeal, My "Creditor Petition" case mgmt is in coming Feb.

Are the above correct?

Looks correct. Don't forget the Memorandum of Appeal. ( inside the Rekod Rayuan )
Notis Rayuan must be filed within 30 days of High Court judge decision.

No, I'm not. I pick up all the law thing from this forum.

I already file the "Notis Rayuan", "Stay Execution" and Afidavit.

Now for rayuan to "Appeal Court" is RM1,600/-

Ok, I'll draft the "Memorandum Rayuan" and show you.

When do I have to file in the "Rekod Rayuan"?

In "Rekod Rayuan", do I need the "Alasan Kehakiman", how is the court going to give me this?

MEMORANDUM RAYUAN

XXXX iaitu perayu yang namanya tersebut diatas merayu kepada keseluruhan keputusan Yang Arif Puan Lau Bee Lan yang diberikan di Kuala Lumpur pada 29 haribulan Januari 2014 atas alasan yang berikut.

1. Hakim Mahkamah Tinggi khilaf kerana beliau menerima alasan dua peguam Pemiutang Penghakiman yang “terlupa” secara serentak, sebagai sebab ketidakhadiran pada hari pembicaraan keputusan pada 11/11/2013.

2. Hakim Mahkahmah Tinggi khilaf kerana tidak mengutamakan Aturan 35 Kaedah 2(3) Kaedah-kaedah Mahkamah 2012 yang mana hak merayu atau mengenepikan Perintah Mahkahmah adalah terjejas jika ketidakhadiran peguam secara sengaja.

3. Hakim Mahkamah Tinggi gagal melihat bahawa pihak pemiutang penghakiman (yang menanggung beban bukti) telah gagal mengemukakan bukti yang mencukupi yang mana ketidakhadiran mereka adalah secara tidak sengaja.

4. Hakim Mahkahmah Tinggi khilaf kerana beliau gagal mengambil kira perbuatan “perjury” oleh peguam pemiutang penghakiman apabila membuat keputusan.

5. Hakim Mahkahmah Tinggi khilaf kerana tidak mengambil kira PKP telah bersetuju yang isu baru boleh dimasukkan ke dalam “Hujahan Bertulis”, oleh kerana “Hujahan Lisan” tidak diadakan.

6. Hakim Mahkahmah Tinggi khilaf kerana alasan terlupa hadir secara serentak oleh dua orang Peguam Pempetisyen Pemiutang adalah amat meragukan.

7. Hakim Mahkamah Tinggi khilaf bila beliau gagal mempertimbangkan bahawa jika adanya keraguan dalam prosiding kebankrapan, pihak yang paling tinggi impeknya (iatu penghutang penghakiman) mestilah diberi kelebihan.

8. Hakim Mahkamah Tinggi khilaf bila beliau gagal mempertimbangkan bahawa jika rayuan ini tidak dibenarkan, kes ini akan menjadi suatu preceden baru dimana alasan “terlupa” boleh dirayu oleh mereka yang gagal hadir ke Mahkahmah.

Perayu / Penghutang Penghakiman

Actually I got other point where the amount in "Bankruptcy Notice" is excessive but the payments were made before the "Court Order".

The opponent says the payments cannot be considered as they weren't paid after the "Court Order". But in the JC afidavit, there is no reason given what the payments are for, just merely says not knowing about the payments.

Do you think I should include the above?

When did the creditor lawyer file Appeal to Judge in Chambers?  Is it within 14 days of PKP decision?

Its broken down to RM1K and RM600, I'm not sure which one is deposit.

Yes it is withing 14 days.

Do you know some of the answer to my questions earlier to notalaywer?

I'm trying to get the Willian Chan book, do you know if the book has samples of "Rekod Rayuan"?

Rekod Rayuan has to be filed within 8 weeks of Notis Rayuan otherwise it is game over.

There is a list of documents required ( for Rekod Rayuan ) listed in parts of this forum.
Search for it.

The Written Grounds of Judgement ( Alasan Penghakiman ) is also required in the Rekod Rayuan, but it is frequently late.
You need to prepare a letter addressed to the Assistant of the Judge requesting for the Alasan Penghakiman. Hand it over to the assistant personally.

The Sealed Perintah ( decision ) is also required in the Rekod Rayuan.
If the sealed perintah is also late, put in the Draft Perintah first.

You may need to file a Rekod Rayuan Tambahan later to include all docs that was late or missing in the Rekod Rayuan.

notalawyer, thanks for the guidance.

during BN hearing, the judge refuse to accept the "perjury" evidence because they were mentioned in "Written Submission" and "Afidavit Menentang Petisyen Pemiutang"

I told the judge that PKP agree new issue can be included inside the "Written Submission" because PKP don't want to do any "Oral Submission", but the judge refuse to listen.

I'll raise this in "Memorandum Rayuan" also.

Please explain more about this "perjury" that the other party is alleged to have committed.
