Hi steven, here is the corrected Notice of Application to Strike out bank's summons and statement of claims

NOTIS PERMOHONAN
(Permohonan Defendan untuk Membatalkan Saman dan Kenyataan Tuntutan Plaintif)

AMBIL PERHATIAN bahawa defendan yang dinamakan diatas bercadang untuk memohon kepada Mahkamah Magistret Kuala Lumpur pada           2012,  pukul          pagi untuk suatu perintah membatalkan
Saman dan Kenyataan Tuntutan Plaintif dan perintah kos RM 500.

Alasan-alasan untuk permohonan ini adalah seperti berikut :-
1. Saman dan Kenyataan Tuntutan ( yang dipinda pada DD/MM/YYYY ) Plaintif tidak mengandungi nombor syarikat plaintif.
2. Oleh kerana kedua-dua dokumen tersebut diatas tidak mengandungi nombor syarikat, defendan tidak dapat mengenalpasti identiti sebenar plaintif.
3. Berdasarkan alasan-alasan (1) dan (2) diatas, Saman dan Kenyataan Tuntutan tersebut adalah cacat dan mestilah dibatalkan kerana Tiada Kausa Tindakan yang boleh dijawab oleh defendan. 

4. Alasan-alasan lain seperti yang dinyatakan dalam Afidavit Sokongan yang difailkan di sini.
5. Oleh yang demikian, saya dengan rendah diri memohon untuk suatu perintah seperti dipohon.

Leave spaces blank for the court to stamp the hearing date and time.

Use this Final Supporting Affidavit.
Sign it in front of Commisioner of Oath and file it quickly.
Send both sealed copies to bank lawyer by registered mail.

1. Saya adalah defendan dalam saman ini
2. Semua fakta-fakta yang dideposkan di sini adalah berdasarkan kepada pengetahuan peribadi saya.
3. Saya mengikrarkan affidavit ini untuk menyokong permohonan saya untuk membatalkan saman dan kenyataan tututan Plaintif.
4. Saya terkejut bila menerima saman dan kenyataan tuntutan daripada plaintif yang tidak mengandungi nombor syarikat.
5. Saya tidak dapat mengenalpasti siapakah plaintif sebenarnya dan adakah plaintif sebuah syarikat yang berdaftar di Malaysia.
6. Saya juga tidak dapat mengenalpasti sama ada plaintif ada mempunyai lesen meminjam wang yang sah, kerana tiada nombor syarikat.

Hi notalawyer,

Thank you so much for your help.  I will get the commissioner of oath to sign the afidavit and e-file it tomorrow morning at Pg and hope to get that sealed copy by 18 April.

May be i will sent an unsealed copy to bank lawyer 1st, then hand delivered the sealed copy to the lawyer when I go to KL on 20 April for this hearing.

By the way do I have to enclose Exhibit of the Saman & Amended Kenyataan Tuntutan in the Afidavit?

Hi notalawyer,

Just received the sealed copy of the Notis Permohonan today.

1)When the hearing on 20 April, do I tell the judge that I had apply to strike out the summon and the Statement of claim ?

2)If the bank lawyer said she does not received or not enough time given to reply to my Notis and ask for postponement, how to reply?

3) Can I still mention to the judge that there is an interlocutory appeal and request for the main proceeding to be suspended while waiting for the appeal in Pg High court to be disposed.?

2)If the bank lawyer said she does not received or not enough time given to reply to my Notis and ask for postponement, how to reply?  Agree to the postponement request.

3) Can I still mention to the judge that there is an interlocutory appeal and request for the main proceeding to be suspended while waiting for the appeal in Pg High court to be disposed.?
Maybe no need now, because your chance killing the summons is fairly high.

If the judge asks "Where is your defence?"

You reply that without company number, you don't know who the plaintiff is, so you cannot file a defence and counterclaim on somebody ( some company ) that you cannot identify.

Then ask that the Application to Strike be heard first before you file your defence.

Hi notalawyer,

It seems like the lawyer and the court did NOT follow rules when filing for Notis Permohonan.
I attended the hearing on 20 Apr at 9.00am

The plaintif had file a Notis Permohonan 26A on 17 Apr and show the samw to the Judge. (but I did not receive until 20 Apr at 5.00pm.) Can she file that documents 3 days before this hearing ?

I told the court I had also file a Notis Permohonan to Stike out the Summon on 16 Apr and show the sealed copy to the Judge.(plaintif lawyer also said she did not received it)

Then the Judge set another date 2x May 2012 for hearing and order both of us to reply each party Notis.

I don't know how to reply to this Aturan 26A documents. 15th May had to attend the case management in front the SAR.

Need your professional advice. TQVM.

Which rule are you referring to? In your case, there is no rule, anybody can file any application anytime. There is no problem here since the hearing did not start and you are given a new date.
Stop worrying about nothing.

Did the Judge still laugh when she read your Notice of Application to Strike?

Then the Judge set another date 2x May 2012 for hearing and order both of us to reply each party Notis.  I don't know how to reply to this Aturan 26A documents. 15th May had to attend the case management in front the SAR.
