Dear notalawyer / others,

I need help and advise regarding this matter.
My father had a loan in 1996, for a shop lot.
However his business went downhill and was unable to made any payment from year 1999 onwards. My mother was the guarantor.
The bank did not take any action from year 1999-2007.
In year 2007, the bank auctioned the property.
And my father was made a bankrupt in last year. But he has already migrated few years back and has no plan to return.
Currently the bank has served the creditor's petition to my mother now aged 60++, the guarantor of the loan, who is a retired government servant.
My parents are already divorced, and I have 4 siblings, I am going to graduate (degree) in June this year, and my 3 other younger siblings are still studying - in college & tertiary education.
Our family sole source of income is my mother's pension which is 2000+.
My mother does not own any property / valuable asset, just a 20year old car, which is not worth much.
Even though I read multiple post that stated that EPF / pension money is not affected, but I also read this from the pension act:
22. (1) An employee shall not be granted a pension, gratuity or other benefit if at the date of his retirement from service in a statutory or local authority—
(a) he has been adjudged a bankrupt or declared insolvent by a court, whether in Malaysia or elsewhere; and
(b) he has not obtained a discharge from such adjudication or declaration.
(2) A pension or other benefit granted under this Act to a person who is subsequently adjudged a bankrupt or declared insolvent by a court, whether in Malaysia or elsewhere, shall cease forthwith.

My question is how can we appeal this?
1. Does the limitation act applies here? Because the loan is long long time ago?
2. We have tried negotiating with the bank, the bank is not accepting any of our amount of proposal, they claim the outstanding debt is too huge. which in fact 70% is the interest I believe - after deducting the loan amount from the auction earnings.
3. I have read the book by William Chan and other threads in this forum about submitting a niat membantah petisyen pemiutang, and filing an affidavit. I dont know what to write in the affidavit as a guarantor? Because finding loop holes is not possible as we do not have any of the loan documents.
4.Can we appeal to the court, because there is really no point in making my mother a bankrupt, and jeopardizing her pension, and jeopardizing our lives by taking away our sole source of income.

Please advise.

Did your mother receive a Notis Kebankrapan?
Did the Petition say that she was served a Notis Kebankrapan personally?

Thank you for your reply.

Notis kebankrapan was served September last year.
My mom tried to appeal to the bank at that time, and the bank say they will take it into consideration.
The bank did not give any reply and my mother thought that the bank has accepted the appeal and would stop the bankruptcy proceedings, therefore did not take any further action.
Yes, the petition mentioned the Notis Kebankrapan was served in September last year.
What should be the next course of action?

Is your father also a bankrupt now?  Check his IC number at Immigration Website.
Was the loan to him or to his company?

You don't have much time left, prepare Notis Niat, Saman Dalam Kamar and Afidavit asap and post here.
You need to file all 3 documents at least 4 days before 19th March.

Yes my father has been confirmed declared bankrupt. But he has already gone overseas a few years back and has no intention of returning. As far as we know he has not reported himself to Jabatan Insolvensi.
The loan was given to him. But i believe the loan was not even supposed to be approved by the bank at the first place. Because my father was just doing some small freelance business at that time with no proof of fixed income. My mother's income bracket at that time was also not qualified as a guarantor. The shop was bought as investment, due to hearsay that can make money after the shop is built and can sell off. But the construction was delayed for a few years due to problem with the construction company and the project abandoned and subsequently resumed, it was not until many many years later. And the shop lot was not able to be rented out or sold even after ready.

Regarding the documents, I am still trying to prepare it, I am at lost as to how to prepare the documents.
I read your previous thread on a sample you written for a borrower, where she did not receive the notis bankruptcy.
But all the clauses you used I am unable to use it.

Can the affidavit be an appeal document? To the court? Like explaining our situation, and mentioned our appeal to the bank, whereby we are willing to pay an amount of money monthly for 5 years?
Or mentioning other loopholes? - But i cannot find any loopholes, dont know how they calculate the interest?
You mention limitation act in a few of your posts - 6 years something - I found the details in the Limitation act - but dont really understand.

Limitation of actions of contract and tort and certain other actions
6. (1) Save as hereinafter provided the following actions shall not be brought after the expiration of six years from the date on which the cause of action accrued, that is to say—
(a) actions founded on a contract or on tort; of Malaysia ACT 254
(b) actions to enforce a recognisance;
(c) actions to enforce an award;
(d) actions to recover any sum recoverable by virtue of any written law other than a penalty or forfeiture or of a sum by way of penalty or forfeiture.
(2) An action for an account shall not be brought in respect of any matter which arose more than six years before the commencement of the action.
(3) An action upon any judgment shall not be brought after the expiration of twelve years from the date on which the judgment became enforceable and no arrears of interest in respect of any judgment debt shall be recovered after the expiration of six years from the date on which the interest became due
(4) An action to recover any penalty or forfeiture or sum by way of penalty or forfeiture recoverable by virtue of any written law shall not be brought after the expiration of one year from the date on which the cause of action accrued: Provided that for the purpose of this subsection the expression “penalty” shall not include a fine to which a person is liable on conviction for a criminal offence.
(5) Nothing in this section shall apply to—
(a) any cause of action within the Admiralty jurisdiction of the High Court which is enforceable in rem other than an action to recover the wages of seamen, or
(b) any action to recover money secured by any mortgage of or charge on land or personal property.

Can it be applied in this case?

For mortgage cases, the bank have up to 12 years to sue.
After they won, the have up to 12 years (from the judgment date) to make your mom a bankrupt.
So, I think all is within limitation, no holes here.

Talking about the "loan should not have been given" is useless now because you should have talked about that when they first sued, not now.

I think the only hole you can use to try prevent bankrupcty in your case, would be to say that your mom has no assets and no disposable income.  This "excuse" has only a 10% chance of success, but it can help delay bankruptcy.

If you do not file anything, your mom will be a bankrupt on 19th March.

If you can delay 2 years, then you will graduate and support the family with new income right?

Yes, any delay is good. Then my other siblings would have graduated as well.
Should I apply for transfer of the case? Eg change of court?
Or one of the section in the book mention asking the court to delay the case to have time to find a lawyer? Of course we cannot afford a lawyer.
So how should I proceed to file the documents? What should i write in the affidavit and the saman dalam kamar?
Just explain about having no assets in the affidavit?

No.  Prepare the 3 docs first.  Post it here for us to check.

Just explain about having no assets in the affidavit?

Yes. No assets, no income except small pension, single mother and have to support 3 kids.
Is the house your mum staying now owned or rented?

Can your mom speak English and Malay?
Is she willing to attend Court to contest the Petition?

Dear notalawyer,

Really appreciate your help on this matter.
The house we are currently staying is a rented house.
My mom can speak some English and Malay.
I am sure I can persuade her to attend court to contest the case, but i'm afraid she is not a very good public speaker and may not sound persuasive.
Should I go on her behalf?
She is very upset now and we are really in deep trouble if the pension money stops.
Other limitations associated with bankruptcy does not really affect her life, she does not have a passport.

Here are the 3 letters i drafted,
Please check and let me know any corrections that can be made.
For the saman dalam kamar, I dont know what date should i put? Is it the hearing date as mentioned in the petisyen pemiutang?
And the last sentence RM1000 thingy - what is that? should i include it as it is?
