Saya, XXXXXX beralamat di XXXXXXXXXX sesungguhnya bersumpah (atau berikrar) dan menyatakan seperti berikut:

1. Pada DD/MM/YYYY, saya menerima surat dari guaman XXXX menyatakan kehakiman ingkar kehadiran terhadap saya sejak DD/MM/YYYY. Oleh kerana saya tidak pernah terima writ saman untuk kehadiran mahkamah pada 25 july 2011, saya telah membuat pangilan dan berjumpa dengan peguam kerani cik XXX, untuk mendapatkan penjelasan. Cik XXX memberi satu salinan dengan kod post berdaftar kepada syarikat dan kediaman saya(sila merujuk kepada exhibit EB1).
2. Setelah saya membuat jejak & kesan pos berdaftar di lamanan pos malaysia, tiada satu surat disampai selamat di tangan saya. Menurut kaedah–kaedah mahkamah tinggi 1980 aturan 10, kaedah 1,sesuatu writ mestilah disampaikan ke diri kepada setiap defendan atau dengan menghantarkannya melalui pos berdaftar Akaun terima yang dibayar dahulu ke alamat akhirnya yang diketahui dan setakat yang dapat dilaksanakan.(sila merujuk jejak & kesan pos berdaftar dari lamanan pos malaysia di exhibit EB2)
3. Walaupun syarikat saya telah ditutup, saya selalu pulang ke premis untuk memastikan surat disampai kepada saya.
4. Menurut exhibit EB2, tarikh mengirim writ saman adalah pada 1 haribulan august 2011 melebihi tarikh menghadiri mahkamah pada 25 haribulan july 2011  writ saman.
5. Kecuaian ini menyebabkan pihak defendan tidak dapat menhadiri dan menbentang writ saman ini.
6. Saya merayu yang mulia tuan arif membenarkan kehakiman ingkar kehadiran di tarik balik dengan kos plaintif

Diangkat sumpah (atau diikrarkan) pada       haribulan       20      di       (melalui terjemahan oleh      ).

If the bank lawyer don't collect the letter, what will happen?
It does not matter. It only matters that you have proof of posting in the receipt / sticker.

What is the e-filing website URL and what is your reference number to print?

The 3 documents that you printed out should be accompanied by a cover letter.
On the cover letter, you must remind them of the date, time and place of the hearing.

Please post the cover letter here for us to check.
Are you prepared on how to talk at the hearing?
Do you plan to use English or Malay at the hearing?

Hi notalawyer,

Can we use English only at the hearing in the court?
I thought only Malay needs to be used in our Malaysian Courts?

Besides this, all submissions of papers to the court need to be in Malay?

Referring to above subject, we have applied to set aside judgment which default judgment served to me on 16 August 2011 at Kuala Lumpur high Court.

We enclose herewith a copy of Notice of intention of Party to Act in Person, Summons in Chambers and Supporting Afidavit document dated 14 September 2011 by way of service on you.

Kindly take note that you are required to attend High Court on 28th September 2011 time 9am to served defendant application to set aside judgment, failing which, we will apply court for a full trial and cost to plaintiff

After they scan my copy of 3 document, they give me the slip. At bottom of slip, "Note: Please visit http://efilling.kehakiman.gov.my for Online document Extraction under eCourt's Public services segment."    I just key in extraction code from my slip and i will get a seal copy of summon of chambers online.

I don't know where is the venue to attend for hearing as did not mention in the summon document.

Kindly take note that the Kuala Lumpur High Court has set 28th September 2011 9am as hearing date for the  application. Kindly attend the hearing, otherwise the hearing will be one-sided.

Kindly acknowledge receipt of this letter and all the attachments.

It is at roughly the same place where you filed the documents.

Can we use English only at the hearing in the court?
Can.

I thought only Malay needs to be used in our Malaysian Courts?
Besides this, all submissions of papers to the court need to be in Malay?

All Notices, Summons and Affidavits etc need to be in Malay.
Submissions (arguments) can be in English.

Send the new cover letter with the 3 documents to bank lawyers asap.
Then after 4-5 days, call bank lawyer up to ask whether they plan to go ahead with the hearing on 28th Sept. or they plan to postpone so they have more time to reply to your affidavit.

Have you called the bank lawyer?
Did the bank lawyer receive your documents?

I check thru post malaysia website track & trace system, again the letter is not delivered successful as of today. I think i have to fax it to them tomorrow.

Hi I got an Summon notice in 2007 on the Hire purchase case and the judgement made. I didn't attended the hearing as the notice was sent to previous address.

My last default payment was in 1998
Ambank file a writ in 2007 and the judgement made.

My question below:

1) May I know if I could appeal to set aside the judgement? Must I have any reason to make an appeal?

2) Can I still apply the Limitation Act 1953 on my case.?

3) Can you recommend a Lawyer for me.?
