Unethical debt collection agency acted like thugs and gangsters. How do I deal with it? What should I do?

I own Maybank RM8,000.00, they also send the same collector [K***** name removed] to speak to me.

First is Daniel who acted as top management and asked me to pay RM4,800.00 immediately. I borrowed from my relatives and did so. Then Devan called and harassed me almost everyday and also said that they will take my car, take my house but I told them that I got nothing then they said very bad words.

When the 1st month of the week sure they will call. Hey, when you get your salary... when you want to pay... I also got so fed-up and I told them that if the keep on calling I will suicide and see what they get. They are ruthless not only to men but to women too! Terrible bank can end up with partners like this...

Only deal with the bank and deprive them of their commission and let them just fold up from lack of money.

If you deal directly with the bank and make any payment, they still get commission because the account is assigned to them.

If the debt collectors go to your house, no need to entertain them.

Tell them straightaway you prefer to deal directly with the bank or tell them, you will request the bank to change another debt collection agency because you are very disappointed with them.

Or you can tell them straight off that you will never entertain strangers at your door. You will only prefer by phone or mail or both. You have the right not to entertain strangers no matter what they claim to represent.

I had been observing most of statements from “faqs”. Sorry to say its not healthy on most statements from faqs.

Pointing fingers without realizing the other fingers targeting back on us, is similarly tarnishing our own image. Others would wonder how bad was the debt that you are avoiding.

DO NOT AVOID. NO MATTER HOW SERIOUS, BANK WILL STILL HAUNT YOU.   
So, stop condemning.

Who cares if they haunt me? Do I owe you money? I am not condemning the bank, I am condemning the way debt collectors do their job.

They pretend to be bank officer, Bank Negara employee or pretend that they have court order to terminate someone job. Are they doing the right thing?

Owing bank is something different, but pretending to be a government officer or bank officers, you will be sentenced to jail if found guilty.

We owe money to the bank because we were careless with our spending. We don't pay back because we have no money to pay back. The bank can always sue us to bankruptcy so we don't really care about debt collectors who are out to make our lives even more difficult. We owe the bank and not you and the bank has the option to sue us if they want. In fact, once we all start ignoring debt collectors, then they would end up with no source of income and maybe might just start being in debts too like us and end up getting harassed by other debt collectors.

Remember the saying, 'what goes round will come round', so one day, all the crap they give to people like us will befall upon them too. Remember, we're just regular people who made some bad decisions in our lives with our finances and they are just sharks out to capitalize on people's misfortune.

I'm glad to stumble upon this forum and have learned a lot about banks and debt collection agencies. For those who give advise here, people like notalawyer, VKPC, faqs and many more, keep up the good work and many thanks for all the advise.

The conduct of the debt collector is totally illegal. Go straight to the police station, make a report, do complain and cc the report to the bank, Bank Negara, the legal firm they pretend-to-be and the debt collector agency. They will be quite after that.

Sometimes they pretend to be someone from Bank Negara or bank staff. Don't they know that it is illegal to pretend to be a government servant or bank employer when they are not?...

This is my report to Maybank and am still wait for answer and action from Maybank. If today I do not receive an answer, I will be going to make a police report, Bank Negara Malaysia (BNM) report and Suruhanjaya Syarikat Malaysia (SSM) report. Hope you all can support me.

ADUAN : TINDAKAN PIHAK MAYBANK YANG TIDAK PROFESIONAL

Perkara di atas adalah dirujuk.

2. Saya telah dihubungi beberapa kali oleh Mr. Txxxxxxx A/L Axxxxxxx (Mr Allen) yang memperkenalkan diri sebagai peguam dari [K***** name removed] PARTNERS & CO SDN BHD yang telah dilantik oleh pihak Maybank untuk membuat kutipan kredit dari saya. Walaubagaimanapun tindakan Mr. Allen kepada saya bagi mendapat kredit melalui perbualan melalui telefon pada jam 3 petang kepada saya adalah sangat BIADAP dan TIDAK PROFESIONAL yang langsung tidak mencerminkan etika korporat yang baik pihak Maybank dan [K***** name removed] PARTNERS & CO SDN BHD itu sendiri.

3. Perkara ini bermula pada awal pagi kira-kira jam 10 pagi apabila Mr Allen menghubungi saya mendesak untuk membuat pembayaran penyelesaian baki kad kredit saya. Saya memaklumkan bahawa saya telah menghubungi pihak Maybank seterusnya mencadangkan saya supaya mengemukakan surat rayuan berhubung perkara ini untuk diselesaikan melalui jadual pinjaman ansuran. Saya bersetuju dan memaklumkan akan membuat pembayaran tertunggak sebanyak RM2000 dan bakinya diselesaikan melalui jadual pinjaman ansuran tersebut. Perkara yang sama turut saya maklumkan kepada Mr. Allen untuk mengemukakan surat rayuan dan menyelesaikan bayaran tersebut tengahari hari yang sama.

4. Walaubagaimanapun saya mengubah fikiran dan telah menyelesaikan keseluruhan baki kad kredit saya berjumlah RM 5507.28 kira-kira jam 12.00 tengahari di Maybank Putrajaya, Presint 3.

5. Kira-kira jam 3 petang, Mr. Allen menghubungi saya meminta salinan surat rayuan yang dikemukakan seterusnya bukti pembayaran RM2000 seperti yang dimaklumkan lebih awal. Saya telah menyatakan bahawa saya tidak membuat surat rayuan terbabit. Dengan tiba-tiba beliau terus memaki hamun saya. Antara kata-kata yang beliau gunakan :-
· - mengatakan saya seorang putar belit
· - mengugut dengan menggunakan nama Jabatan tempat saya bekerja
· - mengugut dengan meletakkan tekanan untuk menjejaskan nama baik Ketua Jabatan saya.
· - menipu dengan menggunakan fakta yang salah berkaitan undang-undang berhubung kaedah pengambilan tatatertib yang boleh dikenakan kepada penjawat awam.
· - mengatakan saya seorang penipu
· - mengatakan saya seorang penghutang yang bodoh
· - mengatakan saya seorang yang miskin hina
· - menghina bapa saya
· - menghina ibu saya
· - membalas dengan menggunakan perkataan ‘puk* mak’ berkali-kali apabila saya terlepas cakap perkataan yang sama apabila dihina oleh Mr. Allen.

6. Persoalan saya kepada pihak Maybank dan [K***** name removed] PARTNERS & CO SDN BHD adakah itu etika seorang pengutip kredit dengan cara menghina dan memalukan orang lain? Sepatutnya Mr. Allen menghubungi dahulu pihak Maybank untuk mengetahui status pembayaran saya sebelum menghubungi saya.

8. Ketika beliau memaki saya dengan kuat, seluruh rakan-rakan saya di pejabat dapat mendengar perbualan tersebut. Hal ini telah memberikan tekanan emosi serta mengaibkan saya selaku salah seorang pelanggan Maybank yang di akui syarikat bank terbaik. Dengan nama baik Maybank yang diakui dunia korporat, sepatutnya hal ini tidak berlaku.

9. Oleh itu saya meminta supaya satu penjelasan bertulis dan juga surat permohonan maaf oleh pihak tuan berhubung perkara ini.

Saya telah pergi ke [K***** name removed] Partners & Co. (M) Sdn. Bhd pada jam 2.30 petang 12 Disember 2011. Sebelum itu saya telah membuat temu janji lebih awal untuk hadir bagi bertemu Mr. Thayalan (Mr. Alan) yang pernah memaki hamun saya dalam telefon. Walaubagaimanapun apabila tiba, dimaklumkan oleh operator terbabit Mr. Alan telah keluar bertemu customer. Tadi sudah janji, last-last tak ada, sapa penakut dan putar belit sebenarnya. Untuk makluman, company ini berada di Kelana Jaya depan dengan padang sekolah.

Walaubagaimanapun, saya hanya di entertain oleh manager beliau Mr. Ragunath (Manager). Takkan nak maki manager dia pula. Aku jenis orang gentleman, tak puas hati baik jumpa dengan orang itu direct. Manager itu cakap akan buat siasatan dalaman. Boleh percaya kah? Huhuhuhu...

Bagi yang cuba mempertahankan tindakan [K***** name removed] dalam thread ini, tolong jawab soalan-soalan saya:-
1. Mana undang-undang Malaysia boleh maki hamun orang lain? Sila tunjukkan.
2. Mana undang-undang Malaysia boleh ugut-ugut orang lain? Sila tunjukkan.
3. Mana undang-undang Malaysia yang membenarkan mengeluarkan kata-kata lucah?
4. Mana undang-undang Malaysia yang boleh ganggu hidup orang lain?

Untuk makluman, saya akan menentang kuat [K***** name removed] dengan apa cara sekalipun. Siapa mereke yang boleh maki ibu-bapa kita? Ayuh gunakan suara anda untuk menyatakan penentangan kepada [K***** name removed]!
