Malaysian Maid Agency breaks the law

This is for public awareness so others do not fall victim to unscrupulous maid agencies & the challenges involving non-compliance of court awards.

A local maid agency has committed criminal offense of not abiding in MORE THAN ONE award handed down by the Tribunal Court.

I had my court hearing with this maid agency on 4th September 2014. Thanks to social media, I came to know of a lady in the same dilemma as me. In both hearings, the judge has awarded us monetary refund due to misrepresentation & incompetent maids who ran away just weeks into their employment.

The maid agency has not only defied the 14 days deadline to pay the award but has ignored appointments fixed by the Ministry of Trade & Consumerism enforcement officers to investigate their non-compliance. This has been dragging on in the past 6 months.

We are at our wits end. To date, we have served the maid agency through our lawyer the Notice 218 which gives them a 21 days deadline. They blatantly ignored this too!

I just want JUSTICE! Any advise or suggestions is greatly appreciated!

Sebuah agensi pekerjaan tempatan telah melanggar undang-undang Akta Perlindungan Pengguna LEBIH DARI 1 KES!!  Saya telah dikunci dalam percanggahan pendapat dengan agensi pembantu rumah di Penang yang tidak memenuhi tanggungjawab mereka. Saya meminta bayaran balik daripada agensi tetapi gagal. Selepas banyak cubaan and kecewaan, saya mendapati harapan terakhir saya - tribunal pengguna.

Kes saya telah ditetapkan untuk didengar di tribunal pada 4 September 2014. Tribunal Presiden menganugerahkan saya bayaran balik yang perlu dibayar oleh agensi pembantu rumah itu dalam tempoh 14 hari atau agensi pembantu rumah akan menghadapi tuduhan jenayah di bawah Seksyen 117 (1) APP 1999!

Tetapi malangnya, agensi pembantu rumah yang enggan membayar balik selepas 14 hari. Saya telah membuat aduan ketidakpatuhan anugerah itu kepada Bahagian Penguatkuasa, Kementerian Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan pada 19 September 2014.

Pada 29 Januari 2015, peguam saya menghantar Notis 218 kepada agensi pembantu rumah, yang mereka perlu membayar bayaran balik dalam tempoh 21 hari. Sehingga hari ini, saya masih belum mendapat semula wang hasil titik peluh saya lagi !!

Don't know why after so many years people are still being conned by maid agencies.

For the benefit of all, read carefully the following:
1. The maid you get directly from their country is real and legal after paying all the fees.
2. The legal maid will abscond.. and being recycled for new customers.
3. The replacement maid can be likely to be "empty" i.e. illegal. But you have already paid for all the "fees".
4. Most maid who absconded are intelligent ones, feigning illness especially mental ones plus homesick.
5. Have you been to Indonesia? Especially Central Java where most of maids come from? Make no mistake, most of them are as educated nearly equal to that of most Malaysians. Ever notice all of them know how to use smartphone and can call home the moment they started work in your house? Kita sini yang betul katak di bawah tempurung.. They are not as backward as we see them to be 20 years ago especially those domestic workers.

To protect your own interests, report to the Immigration Department direct whether there is a replacement given or not. No face or quarters given to the maid agency. Failing to do only encouraging more Malaysians to become future victims. You will be fined by Immigration Department for losing your maid but it is worth it. If you did not report the maid you have brought in direct (under you name) and if the runaway maid in involved in vice, drugs or die under mysterious conditions, the fine is not only much higher but you could be involved in the court cases. You MAY have to bear the costs of sending the corpse back to their country, which for faraway countries, RM10K++. Watch out!

It is more advisable to get maid from far away countries whereby they cannot just "swim" home. The recent Newspaper reports on "holes" at border fences is very, very accurate and true. The ocean is so vast, how to stop illegal entry and exits? Be fair to the relevant security departments too..

Just get the services of part-time maids to do the menial housework.

The work permit that the replacement maid holds.. you can verify if they are real? Even Immigration officers cannot "see" if they are real or not. That is why normally during the raids, they just detain or haul in everybody back to the "camps" to scan thru the work permits.

Very simple.. for replacement maids, just pull a fast one, tell you are bringing them to Immigration Detention Centre to verify their work permits. Those who knew that they are false, will kneel down and beg "tuan or puan" for forgiveness. However, be on the alert that some maids were issued false permits without them knowing it, they being victims too!
