Demotion & Salary Cut

Hi, my company has say that they are going to demote and cut my salary this month.  For the last 6 month I have been target by the boss in terms of harsh verbal treatments.  I attend management meetings and they have said that the business is in trouble this year and they want to cut cost by any ways possible.  However, the reason they are giving to me is that they are not satisfied with my work.  However, there has not been any documented performance reviews for me, what is wrong and what can be improve.  Despite that, me and the whole company still receive the yearly salary increment.  I want to know what can be my options and further actions. Appreciate urgent reply. Thank you.

Hi there

I would say you have a very good case of walking out on constructive dismissal as the Company has no right to demote you and deduct your salary. This is fundamental breach of your contract and as such you should write to the Company if they demote and deduct your salary that you consider it to be a fundamental breach and they have to remedy it within 7 days failing which you would consider yourself to be constructively dismissed. After that you can lodge a complaint within 60 days at the Industrial Relations Department.

I have the simillar issue of demoted but not salary cut. I have highlighted to the company but nothing is done. But I can't walk out like that as I have the risk of being unemployed. Please advise soonest.

Please send letter to the company placing on record that you have been demoted and asking for your previous position back. That would be the first thing to do.

I have highlighted that case and send an email that I was not happy with the reorganization.

Can they demote me? Salary still the same.

Can you describe the exact type of demotion of your case?
If you are pregnant, some previous heavy work assigned can be changed to suit an employee. Some changes can come with less responsibilities. Can it be regarded as demolition?

They took my all my staff and make me report to another person.

Can this be construed as demotion?
