Unpaid leave

Hi,can someone shed some light on calculation of unpaid leave? If I want to go on unpaid leave for 7 days, does the company take account of 31 days or 26 days in a month? My employer calculates ordinary rate of pay x number of days unpaid leave minus the basic pay. Please advise the correct formula as I need to go on unpaid leave soon to study for my exams. Thanks.

Unpaid leave should be calculated with refernce to thee number of days in a month. E.g. If the leave is in April the denominator should be 30 days and if in May the denominator should be 31. The denominator 26 is used for employees covered by the Employment Act and for benefits like annual leave, public holiday, sick leave etc.

Is the Un-utilized Sick Leave claimable too if leaving the company (During Resignation) ?

Can I know if there's a clause in our EA1955 to support this formula?

I have difficulty to explain it to our staff.
