I am single, Chinese girl and I have some questions as below:

1. If I am not married, can I still get the birth certificate for new born baby?
2. Can the father's name to be listed in the birth certificate for new born baby since we are unmarried parents?
3. If the father is a foreigner, what are the procedure and documents needed to get the birth certificate for new born baby?
4. If I register the baby in Malaysia and the father is a foreigner, will the baby become a Malaysia citizen or obtain the citizenship of the father? Or dual citizenship?
5. If the mother is not married and has baby, what is the marital status for the mother? Is she still considered single or otherwise?
6. Will the baby face any problem in the future for example study and anything else because the parents of the baby are not married?

My boyfriend is separated with the wife for more than 8 years but the wife refuses to sign the divorce paper. Now I'm planning to get pregnant and I wonder what will happen to child birth certificate? Since he is still legally married to another women.

1. Can I put the father name in child birth certificate?
2. Assuming I can put in child father name, can my child benefit from the father death (in case anything happen)?
3. If I not able to put in the father name without the marriage certificate, the child surname must follow mine or the biological father surname?
4. Will there be any complication for the child in future? Such as father asset? Custody (in case anything happen to me)?

@ henna

the wife refuse to sign the divorce paper.
File a single petition for divorce

now I'm planning to get pregnant
Hold yr horses, wait for filing of divorce for security. He may actually NOT want to marry again.

Personal opinions to :-
1. Yes
2. If the father has made a WILL naming your child as one of the beneficiary
3. Any name you like including "Aravoot Tanapairin"
4. Answer same as (2) above. If there is a doubt that he may not want custody in the event of your premature demise, don't have child. How can he have custody if he has not been named as father?????

Thanks Jeff005,

By the way how long usually a single Petition take place? We worried the cost will end up far beyond our capabilities.

@ Henna

Please start a new post titled: "How to file for Single Petition Divorce".

I shall answer your questions after 19th August. I can teach your boyfriend on how to deal with nasty wife provided she is more on the "wrong side".

But if he is the nasty husband, I shall teach his ex-wife-to-be how to harass him legally!

We were unmarried parents for my new born baby. In Malaysia do we need paternity test to proof the baby's father or we just need to attend officially and sign the papers only to get the birth certificate?

I am a single mother and also a foreigner. If I got my baby passport, can I take my baby straight back to my country or do I need a special pass in order to go through Immigration at the airport?

Means you are travelling on a foreign passport.

If I got my baby passport, can I take my baby straight back to my country
If baby passport is Malaysian the Immigration will stop you.
It is best your Malaysian husband at the airport to send you off.

If this is an attempt to smuggle child out of the country without the consent of the FATHER, my advise is DO NOT even attempt it. It is an attempted kidnapping which carries a 10 year Jail Term.

Having the child passport does not mean you have custody of the child.

I am a single mother (Chinese woman). I am not married and will deliver a baby in 8 months or later.

My question is, is there any organization/hospital that helps to support me in Malaysia as I planned to continue the pregnancy then give the baby to any parents who are in need?

@ worried woman

Why do you need support? What kind of support?

Call "Befrienders". They have a support base.. (keep on this thread. I will try to get you the number later)

Please do not give up your child if you can. I am also a baby given away at birth.

Life may not be necessary better with adoptive parents.

Whatever you do later, you must get a Birth Certificate for the child before giving the child away. With the birth certificate, legal adoption can be done legally.
