Me and my ex-husband had separated for seven years, but because of some issues so we did not proceed with divorce until last year. I had made the tribunal part at Putrajaya and got the certificate, and just passed all the documents to Biro Pengaduan Awam last two weeks ago. Unfortunately I just found out that I accidentally got pregnant with current boyfriend. I would to know is it possible still get a birth certificate for my baby with the surname of my current boyfriend. The lawyer on duty told me that we have to do a process of adoption, adopting the my baby if we register after the baby give birth. I cannot accept the weird process.

Please give me suggestion tell me what should I do now?

So getting pregnant with another guy while still legally married is not weird but okay?

Your separation could be just a year ago.

You reap what you sow and your child has to suffer for it.

You can register the kid using your current marriage cert but use any surname you like.
You can use your boyfriend's surname or even your own surname.

The Registration Department does not care what name or surname is given.
Even if you put a Japanese name, it will also be accepted.

@Suzzie,

My divorce is still not settled yet but my baby was already born two months ago. We made the birth certificate, just they specific something below about Akta 13. But since can get the birth certificate we don't care much. No worries, as long as your current boyfriend is willing to be the father then will be fine.

@Winnie,

A few more questions if you don't mind:
1. What documents did they ask for?
2. Do my boyfriend and myself have to be present at Jabatan Pendaftaran Negara (JPN)?

Do you have the baby health checkup book? After you deliver your baby, bring along that book and identity card (ID) to Jabatan Pendaftaran Negara (JPN). Any one of you present will be done but that time we two went together.

I believe the clinic will give me the booklet for registering purposes when baby is born. Will be asking my boyfriend to go. Can I know what will they ask and what should I say to register? Sorry for all these questions.

How many months is your baby now? You should have the booklet when you go for checkup.

Jabatan Pendaftaran Negara (JPN) won't ask you anything. You just have to fill in the form. They did ask for marriage certificate but I told them we haven't register yet, then they will understand.

@Winnie,

My baby is due this May. I'm going to private clinic for check ups, I only have an appointment card. I will check with the clinic during my next check up.
