Unethical Agent

I am in the midst of selling my house, the buyer paid 10% and yet to pay balance purchase price.

Early April the agent I appointed took my house key saying need to do valuation but when I went to see my house yesterday there is a family leaving in my house. I immediately called my agent but no answer to my calls and message. So stressed with this situation.

Please advise what to do.

Find out whether the people living in your house is the buyer.

If its buyer, its breach of contract to move in without telling the seller & not settling purchase price.

Just ask the occupants.

They could be the work of scammers.

They could be tenants who had paid deposits. They can be also victims. The buyer could also have been duped by the agent.

The agent called and inform me the prospective buyer's brother has moved in to stay without informing him.

Now what steps can I take since they have move in without informing me & paying the balance purchase price.

What did you pay your lawyers of the S&P and agent with? Peanuts?

I paid the agent 3% of the purchase price although the selling price is below 100,000.

As for the lawyer, she billed me RM1,700 and I will pay once I receive the balance purchase price.

Can I ask those staying in my apartment to pay rent or I lodge a police report if they refuse?

How can you get rental when you do not have a rental agreement with them?
Check and study the T&C of your S&P then,
Give your agent 14days notice to sort things out, then
Bill the buyer rental at market prices till realisation of the S&P within stipulated period, otherwise
Maybe can lodge a report for CBT against your agent for giving keys to others... ppl could be using your house to make broooms..

If you report to the police, the police will do nothing because there is no crime here.  They did not break into the house.

There is no need for a rental agreement.
It is possible that they will pay informal rent if you ask them.
This is because if there are kids living there, they would not want any trouble for the kids.
Get 2 big sized men to go there to collect rental.

Thanks vkpc. You are right. Everyone asked me to do the same.

I met the agent face to face with my brother and he said he will be responsible and will settle the issue in 3 days.

Yes, I did ask them to pay rent. They tried to say like they will move out and just leave their things and can we not pay the rent? I said no, they already breach the contract but got the guts to negotiate this and that.

Will update what happen after 3 days.
