I have paid my earnest deposit for a sub sale property(freehold) to a negotiator, but my cheque is issued under the name of Vendor's lawyer.
The clauses of the agent booking form are:
1) The earnest deposit will be fully refunded if I cant obtain 90% loan within 5 working day;
2) I have to executive the Sale & Purchase Agreement within 14 days from the date of acceptance of this offer by Vendor, failing which the earnest deposit shall be forfeited and the agreement shall be treated as null & void
The vendor has signed the form but rejected to pass his copy of strata title to agent/buyer for my loan application. He requested the cheque to be bank in first.
I m worried the risk of bank in my cheque and timeframe of Execution of Sale & Purchase agreement. As the vendor has delayed for a week for given me his document (strata title) for loan application, I m running short of time..Its impossible for me to get my Sale & Purchase Agreement ready within the timeframe.
Can anyone advise me what should I do?
