I bought two houses in 1997. However due to my bad financial situation, I discontinue my repayment since 2003. So, the banks had asked their lawyers to give me notice in demand since then. It is more than 10 years now. My questions is Can the bank file bankruptcy against me without my present in court? The court have to look for me before they can summon me for bankruptcy? Thanks.

Yes

No need. How to find you if you are hiding? Bankruptcy papers can be served by way of "substituted service" i.e. published in major newspaper. You do not read newspapers? There are daily legal notices for bkcy notices everyday. On a normal sat, NST have over 200 bkcy notices.

Furthermore, as far as I am concern....
The Malaysian court needed my consent before the court before they have the authority to file me. Otherwise as for my case, its has been long time (more than 10 years) I am not even been appeared in the newspaper's bankruptcy notices. What is your opinion? Thank you.

How old are you? U r cute... U better read on bkcy laws under the bkcy laws section of this forum. You appear to be "Higher" than the High Court of Malaya.

At such, how can I know I already been filed by bankruptcy?
1/ Check with CTOS
2/ Check with JIM1
3/ Check with JIM2
4/ Go to any High Court service counter to see if there has been any filings on your name before.

I am not even been appeared in the newspaper's bankruptcy notices
What did you do? You have been reading 3 major newspapers in 3 major languages for the past 10years without fail everyday?

If at all I was in the position that I had been filed. Then, why until today, the court did not instruct Immigration to ceased my passport prohibited my travelling? Furthermore, since 2003, which about 12 years now; I only received notice of demand from the bank's lawyer, but why I did not received any court order for my bankruptcy trial? Kindly anybody explain??

Nobody wrote that a bkcy has been filed against you.

You have asked so many whys' that ppl could not answer. Only you can answer easily. Just go the the lawyer that sent you the letter of demand and ask them WHY?.

You write and present your issues bit by bit..

The answer is very simple.

The bank has 6 years to file legally to make you a Judgement Debtor, then take another 12 years to make you a bankrupt. Meanwhile the interests runs (default interests rate can double pending on the loan contract sign). By the end of 18years, a 50k default at year 1 can be more than 1M.. Why need to bankrupt you now? Wait for another 8 years would be more fruitful for the banks.. 10x interests received legally..

WHY.., WHY.., TELL ME WHY.. WHY IS THE SKY SO HIGH..??
