I wish to get some advise from you as I have problem with my Apartment unit in Suria Kinrara.

I bought an apartment unit at Suria Kinrara Puchong in 2012 and only in 2013 I realized that there is an outstanding maintenance fee RM14xx from previous owner. Of course I refused to pay, so I made a complaint to the Management Office and the manager told me that he does not have the authority to waive the outstanding maintenance fee, and he would bring up this issue during next AGM for further action.
I waited for few months, then the Maintenance Office manager told me that he could not do anything and he suggested that he would bring up the same issue on the next EGM. Again, few months later, no solution. The Maintenance Office manager then promised to seek advise from HQ. Few months have passed, the manager told me that HQ confirmed that they could not waive the outstanding maintenance fee and the current owner would have to settle it.

I then approach my S&P lawyer for help in April 2014, they told me that the previous owner "Sentosa Restu (M) Sdn Bhd" was under liquidation, Sentosa Restu (M) Sdn Bhd was the subsidiary of developer Talam. And the new liquidator has no record to verify and they refuse to pay. So my S&P lawyer showed me one clause 11.01 Article XI-Outgoings under the S&P that:

"All quit rent, rates, assessment and taxes and other outgoings payable in respect of the said Property including all arrears thereof shall be paid by the Purchaser(s) to the relevant authorities/parties upon the execution of this Agreement."

Finally, my S&P lawyer throw this ball back to me. RM14xx is not a small amount to me, what should I do next?

Please advise. Many Thanks.

Yes, unfortunately we have to pay for it due to developer under liquidation. I faced the same fate as yours but mine from another project.

As pending, we have to pay the pending amount until case settlements which take years.

You signed this S&P agreement which says you agree to pay everything.
So, what is the problem now?
Pay as agreed-lah.
