Regaining Malaysian Citizenship (Got Australian Citizenship 8 Years Ago)

Just a quick question. About 10 years ago my family and I migrated to Australia from Malaysia. I was then asked by my dad to obtain Australian citizenship shortly after for certain purposes.

I have never formally renounced my Malaysian citizenship (ie never submitted any formal forms to the Malaysian govt).

I am curious as to whether I can still 'covertly' maintain my Malaysian citizenship in this case?

I still have my old IC card from my high school days (ie the pre-MyKad one).

I also have my Malaysian passport too, most likely expired now.

However, I have flown into Malaysia a couple of times now using my Australian passport.

What would qualify me in the eyes of the Malaysian govt as being a 'Malaysian' still? I'd venture to guess that I'd need to update my IC into a MyKad and somehow renew my Malaysian passport??

And lastly, is any of this strictly illegal in the eyes of the Malaysian law? Ie what would happen to me if I was caught out by the Malaysian govt for trying to maintain my Malaysian citizenship? I would have thought at the very worst, they'd only reject my application, but no problems as I can always fall back on my Australian citizenship and passport. Am I right in my assumptions?

My situation is a bit different here. Recently, I have obtained Australian passport and my Malaysian passport is not expired yet. I have also officially changed my given name - e.g. From Wong A. B. to Darren Wong.

I plan to travel back to Malaysia using my Malaysian passport and renew it soon after.

Here is the part that I am really confused, which is the best way to travel back to Australia from Malaysia?

Shall I travel to Singapore from Malaysia (using Malaysia passport) and then fly back to Australia from Singapore (using Australian passport)?

Has anyone done this before?

I think you can't leave Singapore with you Aussie passport as you would then be considered a Malaysian over-stayer in Singapore. You have to leave a country with the same passport you came in by. If you leave Singapore with your Mal passport and enter Australia with your Aussie passport, there's no issues as far as I can see. You're an Aussie citizen returning back, and Australia allows dual citizenship, so a lack of an exit stamp from your departure port would not be a problem to Aussie immigration.

Thanks for your reply and suggestion. I am thinking to enter and leave Malaysia with my Aussie passport. I just want to keep my Malaysian passport not expired. Not going to use Malaysia passport unless I want to travel to SEA.  I hope is fine..

Dyingtocomeback - haven't heard anything on here from you for awhile. How is the process going? I renewed my Malaysian passport successfully, hope you were able to do the same. Now for the question of how to exit with my Aussie passport so that I don't overstay and then re-enter again with my Malaysian passport without raising any alarm at immigration?

Hi Seeking,

Am facing a similar problem to you but am on a NZ passport. Have got a new Mykad but am nervous about renewing my expired Malaysian passport, which expired years ago. Can you please tell me how you got yours done?(reported it lost or did you just show them your old expired one)

Hi Seeking/Aussie,

A question....assuming you have changed name to Darren Wong, when you buy your air ticket back to Australia from KL, you will be using your Australian Passport with Darren Wong. But you have entered Malaysia using your valid Malaysian passport with old name Wong A.B

You can't be buying a ticket using your Malaysian passport as it will not have a valid visa to enter Australia and the check-in counter would not be able to print out your boarding pass as it goes to a APPQ check with Australia for valid visa. As far as i know, Airlines now do a check on visa and if you are found without a valid visa, the boarding pass cannot be printed as airlines were fine heftily if they transport a pax to a country without valid visa.

Hence, you will have to buy a ticket using your valid Aussie passport with changed name Darren Wong.

Assuming all is good after check in and BP printed, you can go thru autogate using Malaysian passport to depart as you came in using Malaysia passport. Upon arrival at Australia port, you enter using your Australian passport.

What happens if the autogate is not working/available and u have to go thru normal Immigration counter at KLIA and they ask for boarding pass and it carries your Darren Wong, how do you justify that to the immigration officer when your Malaysian Passport shows Wong A.B? This is the dilemma situation.

Darkdave - I'm researching how to exit with Malaysian passport after I renew my expired one in Malaysia. But I will be entering the country with Australian passport. I understand there are 2-3 gates at the Malaysia-Thai border, so do I exit the 1st gate with Malaysian passport then 2nd gate with Australian passport? Do the officers check whether I already have a exit stamp from the previous gate?

How did your renewal go?

And has anyone managed to enter Malaysia using their unused renewed Malaysia passport via the electronic gates?

Really appreciate your feedback! I'm flying out in 2 days time.

Well, you can always try and then come back here to tell us. They can confiscate your passport and ask you to report to Immigration HQ or detain you till you confess on how you have exited in the first place. The worsted is to charge you in Immigration court for human trafficking.
