Tuntutan kemalangan yang mengakibatkan kematian

Kisah saya bermula begini... Pada tahun 2012, saya telah kematian arwah suami yang terlibat dalam kemalangan akibat kecuaian daripada pemandu yang juga merupakan rakan arwah suami.

Pertanyaan saya, boleh saya membuat tuntutan pada rakan arwah atau syarikat insuran? Ini kerana jawapan dan pandangan yang diterima saya pada awal kejadian kalau nak tuntut pada rakan arwah dia bukan ada duit nak bayar, paling teruk masuk penjara dan kalau nak tuntut pada syarikat insurans tak boleh sebab empunya kereta tak ambil cover untuk penumpang.

Saya benar-benar buntu kerana disebabkan kejadian ini saya telah kehilangan punca utama pendapatan keluarga. Tolong bantu saya. Terima kasih!

I am sorry about your sad case.

I 'borak-borak' or chat with some friends last night (all over 60 years old) and I mention your predicament and ask one of the "casual" friend who was in insurance before.

Since the driver of the car did not buy passenger liability, yes, there is no claim. But you can approach this entity: "MALAYSIAN MOTOR INSURANCE POOL" at www.mnrb.com.my/mssb

They maybe able to help you. Please take note you are not making a claim against them Malaysian Motor Insurance Pool (MMIP), seek redress and advice. And you may need a lawyer to present your case in a court of law. A lot also depends on the nature of the accident.

Since you are a widower and most probably single parent, approach NGOs for help, and/or get free legal aid from Biro Bantuan Guaman (BBG) or Bar Council Free Legal Aid Bureau nearest to your residence. Your case is highly technical in nature in insurance law and not many people are aware of this recourse.

This is maximum info, the rest lies on yourself. But do re-post if you are successful, so that others can follow this course of action.

Please also take note that there is also a time limit for you to make a case against INSURANCE, not against MMIP.
