Hi,

1) I married less than 2 years can I file divorce?
2) I have baby boy age 6 months can I get child custody?
3) If my husband don't want divorce can I apply divorce?
4) I have blasklist at bank, the judge will give me child custody?

1/ After 2 years can file for divorce for either side.
2/ There are major types of child custody a) FULL custody  b) Joint custody
3/ Can apply for divorce after 2 years. If one party disagree, have to go thru  Marriage Tribunal at JPN.
4/ It Depends on the degree of blacklisting by banks and your employment status and how good is the lawyer representing the other party. It is up to the High Court Judge to decide for the "best interests" of the child. There is no fixed rules for child custody although Msian Laws favour the mother

Hi

1) That mean I need to wait till 2 year?
2) Me & my husband really can't live together, any solution? Can I apply single dirvoce?
3) Not Malaysia law child below 7 years the child to mother?
4) my salary higher than my husband. Can I get child custody?
5) can advise in processing divorce maybe take 6-9 months, in this period the kid is follow mother & father?

1/ YES, After 2 years
2/ Me & my husband really can't live together, any solution?
Pay a visit to Marriage Counselors. Make an attempt for Reconciliation (personal opinion).
Can I apply single dirvoce?
YES.. U can apply for Single Petition Divorce
3/ YES, Msian Laws provide as such. But good Lawyers can contest this one-sided gender biased LAW.
4/ YES, U can get Full or Joint Custody.
5/ A Joint Petition can take a few months.
A Simple Divoce can take months to a year.
A Contested Divorce can more than a year.
A Highly Contested Divorce can take years.

Divorce processing if take a year then my baby the judge will give stay with me or my husband? If me & my husband separate live.

Assuming that the child is living with the Father now, you can get a lawyer to make an application to the Court for an "Interim Child Custody". Inside this application, you can seek proportionate "child maintenance" for the time being pending Divorce Proceedings. Vice versa.

This is a prelude for an impeding divorce which I strongly advise, against using this mode(personal
opinion). Do try the reconciliation or mediation method.

If you do seek "interim child custody", please get the services of Legal Practising Divorce Lawyers. There is no costs savings in such cases. You can get the services of Divorce Lawyers from listings in the Website of Bar Council and Lawyerment.com
