Power of Attorney Malaysia. How to get the POA?

POA is legal document that allows a person (Referred to as Donor) to appoint another person (known as the Donee), which authorises the Donee to act on behalf of the Donor in any dealings of physical or non-physical assets such as land, property, shares or intellectual property.



How do I get power of attorney in Malaysia?

To create a valid power of attorney, it must be executed and authenticated in accordance with Section 3 of the Power of Attorney Act 1949* ("PA 1949")[1], duly stamped at the stamp office, and deposited in the High Court in accordance with Section 4(1) of the PA 1949. 29 Dec 2022

Example :

A single mother who has a property in Malaysia but now re-married and residing overseas can apply for a P.O.A. issued to one of her Malaysian children residing inside Malaysia.

With the P.O.A. any landed property under her single name with no encumbrances (fully paid), the son/daughter can sell the property.

The proceeds from the sale will be credited into a Joint Account (with the mother as first name).

A Specialized Lawyer is required for such an action.

A P.O.A. can also be used and executed for the rental of her property while residing overseas without always coming back to Malaysia to sign and execute Rental Agreements as required by Property Laws.
