Overstaying in Malaysia for almost 4 months

I have a Chinese Citizen friend who applied MTEP pass (it’s under MDEC) through an agent in 2021 August and entered Malaysia in March 2022 by approval letter of the pass and a letter of permission to enter Malaysia, both issued by MDEC. 

He then pass his passport to the agent for endorsement right after his quarantine. As per the agent said, endorsement will be done in a month but he waited for 3 months and it’s still not done. My friend is worried and asked to withdraw his passport and wanted to leave the country. 

He found another agent to apply SP for him to leave but failed (it took him one month here). And he tried another agent who promised his SP to be done in 14 working days and still failed. 

His stamp, the one he got when entering Malaysia was expired on 16/04/2022. 

So he has a few question here:
1. If he goes to Putrajaya by himself and talk about his situation, will he be locked up? 

2. If he paid his compound and got his special pass, is it a 100% chance for him to get blacklisted when exiting at the immigration? 

3. Must he go back to his home country directly if he got the SP or he can go to other country?

For years (4), I have posting here in this forum the following :

YES.. correct. But read the T&C at the MDEC website again...  properly.
It states that it only issues PVP (Temporary Pass) just to enter Malaysia only within a specific validity period and a specific period of stay.

Once entered Malaysia under the conditions imposed for this MTEP, the next application is under ESD.

(but he waited for 3 months)
How come?
Why?
Cuz he used agent..!! For MDEC and ESD, there must be confirmation from them. The applicant will be given an acct and his/her own password to read regular notifications on the status of their application.

(He found another agent to apply SP for him to leave but failed)
AGENT AGAIN..!!
Walk personally to the nearest immigration center and you can get it within 14 days, sometimes even 7 days if there is flight availability.

(And he tried another agent who promised his SP)
AGENT AGAIN..!!

1. If he goes to Putrajaya by himself 
He is supposed to voluntary surrender personally..!!
There is no locked up

2. If he paid his compound and got his special pass
Overstay is overstay even for 1 day.
It depends on valid reasons for overstaying, in this case there is a record with MDEC for MTEP. It can be a short blacklist from entering only and it must be within 3-6 months of any overstay.

3. Must he go back to his home country directly
Normally, any self deportation is back to source country.
Again it depends on a lot of other conditions due to covid-22 restrictive travels.
If parts of China is now under lockdown, and if the inbound country issues a China National a VISA to enter, MY IMI "may" allow deportation to third country.

Normally the SP will state "making arrangements to exit".

Fresh from the my oven of overstay issues and solutions.

The above MTEP/MDEC issue for a Canadian Chinese, is temporarily resolved.

The application for a  extension SPECIAL PASS  for the purpose of application to MDEC & ESD within 30 days from date of issue has been approved.

The procedures are as follows :

1. Surrender to nearest MY IMI (there is no jail term)

2. Write a supporting letter with valid reasons on why he overstay (with supporting docs).

3. Make an application for Extension Special Pass  for the purpose of completion of application for the MTEP via MDEC.

4.  There will a compound fine of RM1,000 (plus RM100 for the SP) for the 4 months overstay.

5.  Once the compound fine has been paid, the SP will be issued.

6.  With this SP, you would be then re-legalized with a valid status to be inside Malaysia.

7.  Then go personally to MDEC and submit your application for the MTEP. MDEC cannot process the MTEP application without a valid pass.

I repeat :  DO NOT USE AGENTS EVER AGAIN .. !!

Nota :
No further docs will be posted as for the above (was a paid process /advise). Privacy will be honored.

This is the re-legalization process if still wants to work / invest in Malaysia. No need to go back to China.

Do note that the above applicant (Canadian Chinese) has overstayed for 7 months hence the compound fine is RM2,000

If the above Chinese National do not surrender ASAP and continue with the MTEP /MDEC application, he would 100% be blacklisted definitely for the 4 months overstay..!!

Make your own choice.. either to go back and be blacklisted or stay and continue the application (if he still wants to).

Period..

NOTA :  This is a real (days old) successful re-legalization  for overstay with valid reason and supporting docs.
