Appeal Process for BLI WM/ KLIA /BIO

Good day sirs and madams. My inquiry is of the above. My step daughter had to leave malaysia to get her student visa. But she had overstayed her special pass by 7 days, but only because her flight earlier hor canceled. So she exited but she was given a 5 year blanket ban as is the new policy. Could i get some guidance on this issue as to how I may resolve it. Thank you kindly.

Overstay on a cancelled flight is never an issue.

As far as i know, the laws & policies as at this point of time does not have this policy on the infringement as have been tendered above...

how I may resolve it (leave malaysia to get her student visa)
Let EMGS resolve this issue.

Mesti ade udeng di bwh batu... dlm perkara sprt di atas..

Ok. She has left malaysia. There are no other issues here besides that as she was legally in the country.

P/s : I don’t understand what you mean by ada udang disebalik batu. If they wanted a fine, we would have paid it…

Sorry, it is my metaphor way of writing..

There is no such "udeng" in malay but there is "something".. rite? So, we do not know what is the real issue but now you have answered oledi..  (she was legally in the country).

If they wanted a fine, we would have paid it…
It is not about paying fines, it is about long overstaying illegally inside Malaysia.

The laws for overstay are
1. Penalty plus
2. Jail term and/or fines in lieu of jail term.
3. Blacklisting

Under MY IMI laws, there is a provision for "Appeal" of blacklisting and the degree period of blacklisting, depending on period of overstay and number of IMI offenses.

This is my personal opinion :

For your case there are 2 infringements
1. Overstay
2. Issue "Special Pass" for exit after overstay, but did not exit.
This is a count of 2 charges.

For flights cancelled, you have to get evidence from KLIA2 management, and then go back to IMI HQ for extension of the validity period of the special pass. And actually, the pre-paid air-ticket shown to the IMI for the issuance of the special pass, it is the responsibility to fly the traveler on the next available flight (which can be next day) while remaining inside the airport lounge (depending on destinations).

"Something" is inside her travel issues.. Up to U to investigate and to make an appeal (usually after 2 years).

There is still hope in bringing your step daughter back asap.

First find the root of her problem. You have posted the exit stamp, can you post the last entry stamp into Malaysia so that I may be able to find the root of the problem?

If there is documented application from EMGS (a Govt Agency) for the purpose of Further Education, do make use of this agency to substantiate your appeal in MY IMI. This mode is to use one govt agency to approve the entry of a blacklist person. It is possible if the any IMI infringement is not a serious one.

The appeal must be made by a Malaysian Parent or a legally adoptive parent of Malaysian descent.

Yes, the condition for applying for further education (Student Visa) for foreigners must be made from source country and not while she is inside Malaysia. But sometimes teenagers were trapped inside Malaysia due to lockdown on flights.

The strength of the appeal is based on a legal parental marriage and unintentional overstay.

Even if you, yourself is a foreigner, it can also be applied for, if there is concrete proof that there is long term residency on your part.

@bill madison is your daughter in malaysia now? or how far is the process your daughters education. My daughter is facing the same issue.
