Dikejar debt collector untuk tuntutan hutang bagi pinjaman pada tahun 2006/2007 yang telah pun mencecah 200k++

Mohon nasihat dan pandangan dari pihak tuan.
Saya telah dihubungi oleh sebuah syarikat debt collector yang memaklumkan bahawa mereka ada maklumat hutang yang telah dijual kepada mereka oleh sebuah bank tempatan. Maklumat hutang tersebut adalah

- Hutang untuk 2 kad kredit untuk tahun 2006 dan 2007 dengan hutang terkumpul bagi kedua-dua CC tersebut sekarang adalah rm 170 K ++. Bayaran terakhir saya lakukan untuk kedua-dua kad ini adalah pada tahun 2008
- Hutang kereta waja (telah ditarik dan di lelong pada tahun 2007) yang sekarang berjumlah rm 40 k++

Jumlah hutang : rm 210k++

Status sekarang adalah debt collector ini kerap menghubungi saya di tempat kerja dan malah telah pun datang ke tempat kerja saya untuk berjumpa berkenaan hutang-hutang ini terutamanya jika saya tidak mengangkat panggilan mereka . Ini telah menyebabkan pekerja-pekerja lain di tempat kerja saya merungut berkenaan situasi ini. Saya telah pun menghubungi mereka memberitahu supaya jangan lagi menghubungi saya atau datang ke tempat kerja saya tetapi mereka juga memaklumkan bahawa saya pun perlu juga lakukan pembayaran tehadap hutang ini semua jika ingin isu ini diselesaikan. Saya kemudian mengarahkan mereka untuk menghantar ke email saya semua maklumat terperinci berkaitan hutang - hutang tersebut untuk tujuan rujukan saya sebelum saya membuat sebarang keputusan. Mohon nasihat pihak tuan berkenaan

1. Perlukah saya membayar hutang-hutang CC dan kereta ini semua  memandangkan ianya telah pun melebihi 6 tahun dari tahun terakhir saya lakukan pembayaran  berpandukan akta had masa 1953 ???
2. Bagaimanakah saya ingin memberhentikan terus debt collector sekarang daripada mengganggu saya atau mana-mana debt collector yang mungkin akan dilantik dimasa depan jika akaun hutang saya ini diambil alih oleh debt collector yang lain jika option saya adalah untuk tidak membayar hutang ini ???
3. Adakah tindakan saya untuk memaklumkan debt collector supaya tidak lagi mengganggu saya ditempat kerja dan mengarahkan maklumat hutang saya yang mereka ada untuk dihantar ke email saya bagi tujuan rujukan saya adalah satu tindakan yang betul dan sah? atau saya perlu ke pejabat mereka untuk mengambil notis bertulis berkenaan maklumat hutang tersebut???
4. Sekiranya saya tidak perlu bayar hutang tersebut dan tuntutan telah dibuat keatas saya dan  saya perlu hadir ke mahkamah, bagaimanakah ingin saya mebuktikan di mahkamah bahawa hutang - hutang saya ini semua saya tidak perlu dibayar berpandukan akta had masa 1953 tersebut.???

???? ... a week has passed what happened to the demand letter from allgon.
Lost in the mail?

By what has been stated as in the demand letter, allgon should have filed a summons in court after the 7 days notice and should have reached you by now

OR..  is the above comment post about receiving letter of demand, the act of bill collectors or even DCs who is also owing bank debts. The main purpose is scare the hell out of debtors?

In the absence of any documentary evidence, please discard whatever can be posted by possible debt collecting agents in the hope that you will pay some moneys and then thus make admission to the old debt and lose the protection of the Limitation Act 2018.

What is the issue of posting allgon's Letter of Demand?
The letter is posted by a company's letterhead and hence no PDPA infringements and all you can and have to do is just to darken your name (but your name is already darken and blacklisted). So, What is the issue?

Please stop scaring the people who is reading this forum.

Just to update- So far no legal suit or whatever.

Still the same call, few times a day. when asked to provide statement for verification they mentioned will do so but until now nothing la. so just let it be lor. until there is further action then i will update.

These are common "acts of mental terrorism" carried out by DCs.
To scare and terrorize those who is poorly educated and unaware of litigation laws.

They commonly spam threats of Demand Letter, Lawsuits Writ Summons, WSS, Garnishee Order, JDS, Bankrapsi.. et cetera.. et cetera

The bone of contention is that can they do it successfully?.. once it has breached the 6 years Limitation period. Even with a Judgment Debt accorded, there is still another corresponding limitation period and 1 year limitation period to carry out the "perlaksanaan" (action application).

The regurgitated  misinformation is purely act of debts collectors' propaganda
Do not be intimidated and scared by these propaganda.

Debts collectors thinks that they have the Rule of Sanctimonious Law.

Some msgs send to debtors (old debts) is somewhat filled with pejoratives  (in my personal description).

UPDATE :  Freshly baked from the oven of DCs representing Allgon..

A passionate pleading from the DCs for RM500 to "continue instalments".

It was unethical to send such msgs to the relatives of the debtor..!!
(against the collection policies of BNM)

This can be regarded as intimidation and harassment ..!!

Just for update too, when i got the letter of demand - i was worried and i actually consulted few lawyers in preparation for the case to be filed.

At least 3 of them mentioned the selling of debt to Aigon DOES NOT renew the 6 years limit. and all of them mention the 6 years starts from the last day of payment or the default date.  so unless you admitted or make payment ( admission of debt must be clear and unequivocal ( meaning leaving no doubt of that admission) then it will not trigger or reset the limitation act. 

@ Dr Remi, so what is the status of your case? i assume same like mine la, call call call and watsapp watsapp but nothing taken in court yet. if they do then get a lawyer to help strike it out based on limitation act and that will be end of the nuisance of them calling.

And for those who have lost their bank statement - i have also ask the lawyer on this , and according to the lawyer , basically it is ok, though is better if you still have those statements. BUT if not also is ok ,  the burden on providing the statement to prove the claim , rest on the planttive not the defendant.

Is it the same case as the one that you mentioned that the bank has "withdrawn the lawsuit" and you have paid sumting to get it withdrawn? If it is, then the clock has already be rewound, and the "vesting order" (if any) is now valid for the next 12 years.

You have written so much that i,m in utter konfusion over your different cases with no proper docs tender and on which bank the debt has occurred..

@ Jeff - the one i paid is RHB - totally close - clean. Nothing more to update. if only i have known of the limitation act at that time i wont pay. But anyway is over no need to talk about it already.

the Aigon is the CIMB case. totally different.
