Dear helpful,

My husband has a child born out of wedlock with his mistress. Can I put a request to JPN using our marriage cert alone to obtain for proof that the child is his?

What is the procedure?

I do not have the mistress nor the child's name.

The Laws does not allow it.
In any case, your husband name can never appear in the Birth Certificate of the child as he is still married to U and is about to be your ex...
To try to prove that the child belongs your husband would requires a DNA test which requires both the permission of the Mother and purported Father. If the man does not allow it, nothing can be done.

You are working on zero grounds.
However, you can choose for a divorce if you have been married for 2 years.
And...  Adultery is not a solid ground for divorces.
Paternity Lawsuits can only be initiated by the mistress or the "father".

Btw..
If that mistress knows me well (before the birth of the child), she can make an  indecent proposal  to me to put my name as "father" in the birth certificate of the poor innocent child  for a substantial sum of moneys, says RM1,000,000 because my records in JPN is a widower, a divorcee and now is of "single status".
This only works for non-Muslim unions.

Any decent offers..??
(I'm about to be homeless due the economic woes caused by the Covid-19 Pandemic).

The father can put his name and sign as long as he is present with the mother of the child during registration.
Only thing is the child is illegitimate, for now that is.

It can and it has been legally done to do a birth search by the wife, I am here to see if someone may know more.

Did u apply for the moratorium? I hope u find a way to sustain yourself.
There are many families who need help, many fathers and mothers who are not sleeping at night from worry about bills and loans to pay and mouths to feed, especially those who have lost their jobs or received pay cuts or forced leaves. May they find opportunities and recover quickly. Times are indeed very bad.

Which very smart lawyer told you so?
Have you been as a father who has signed on S.D. at the registration of birth of a child at JPN?

it has been legally done to do a birth search by the wife
Please show proof of this statement of which a 3rd party can obtain search legally.
How much was paid for this illegal search.
Details of this illegal search cannot be accepted by a Court of Law.
This is why many people loses their lawsuits in Court..!!

iF some people says can.. then you do it. No need to come to this website to ask. Just go to any JPN and do the search..!!

Btw
I'm asking for financial offers to be a registered father to a child born out of wedlock so that the child would not be deemed as an illegitimate child at birth. At least there is a father's name stated in the B.C. Still regarded as illegitimate in the eyes of the law without a marriage certificate in Malaysia.

do not apply the laws of birth registration of some other countries in Malaysia..!!
