Malaysia Employer Holding Passport of Foreign Worker?

Can the employer hold the passports of a foreign employee working for him? I have checked the Immigration Act and also the Passport Act 1966. I could not find the answer.

Kindly advise.

Passport Act 1966

Can the employer hold the passport of a foreign employee
It is not explicitly indicated in the above Acts.
But it exists in Bylaws and Policies not meant for public.

May I enquire what was actually the issue you are facing and is asking?

And what category of Foreigner Workers are you referring to?

There is no DP10 or DP11 VISA.
This is just the application form number available from immigration website...!!

And the I-KAD has been obsoleted in June 2019.

And the checking of Expat Work Permit is not found in the website stated above.
It is from 2 other Government websites not related to Malaysia Immigration website..!!

Immigration Dept temporarily suspends i-Kad for foreign workers due to technical issues

PUTRAJAYA, Sept 17 — The issuance of i-Kad for foreign workers has been suspended temporarily since July 17 this year due to some technical issues, said Immigration Department director-general Datuk Khairul Dzaimee Daud.

Following this development, foreign workers are required to carry their passport for the time being, he said.

“We are trying our best to solve the (technical) issues as soon as possible,” said Khairul Dzaimee when contacted, here today.

The i-Kad was introduced in 2014 as an identification card for foreigners to help authorities track illegal immigrants.

The i-Kad is issued based on the sector the foreign worker is in — differentiated by the colour of the card — namely expatriates (gold), agriculture (green), plantation (orange), construction (grey), services (yellow), manufacturing (red) and domestic helpers (brown).

The i-Kad is equipped with advanced security features including the biometric and barcodes to facilitate inspections by the authorities. — Bernama

Foreigners are being scammed by fake Consultancy Firms with the usage of DP10, DP11, terms. Unsuspecting innocent applicants are paying as much as RM10,000 for DP10 alone.
They ended up with faked Employment Pass issued by forgery means using fake companies.

Take NOTE:

DP10 Application Form is not submitted direct to the Malaysia Immigration by the Employer/Employee.

I do not wish to state the application process here, or else, those scammers will refine their write-ups to cheat Foreigners.

Go to the Malaysia Immigration Official Website, the actual application Process is fully stated inside. Only Professional Valid Employers/H.R. Personnel can only understand.
