Received letter from Court " SAMAN PENGHUTANG PENGHAKIMAN"

Good day to all, 

I need some help regarding the matter. i just received a letter from some despatch claim to be a lawyer firm regarding a court summon. They send it to my office address. i check my ctos record that the loan made was july 2011. Need some advice on how to deal with it. thank you

You were adjudged a Judgement Debtor on the 19.11.2015.

Being a Judgement Debtor you can be subject to further execution by the bank in order to get their money back from you.

The following are options the Bank has for their further execution:-
1. Writ of Seizure and Sale.
2. Garnishee Proceedings.
3. Judgement Debtor Summon.
4. Bankruptcy Proceedings.

They have chosen option #3.

They summon you to court to check on your ability to repay the judgement sum. 

If you have zero income, no assets or property to be seized then nothing much can be done to you.

Since you say you received this JDS at your office it mean you are under a gainful employment. Then they (the lawyer and the magistrate) may ask about your salary ..etc.

You can take this opportunity to propose to the magistrate for repayment by monthly installment in minimum amount affordable to you.. eg RM50 per month. 

The amount you propose will need to be justified by an income and expense statement.

Thank you rara for your answer. But latest on my CTOS report i did not received any legal letter on 19.11.2015? if the bank issue any summon it will be noted on our CTOS record right?

Are you saying that if a private company like CTOS forgot to key in your info, then you don't have to attend Court for the Judgement Debtor Summons?
