break contract

Hi Sir,

Just an argument and chit chat after meal, would like to seek opinion from you.
A couple enter a restaurant and order dishes. The guy ate dinner before so he didn't order any food or drinks but only to accompany the lady for dinner. The lady order a dish. However, the waitress inform the lady  "minimum one dish per person". The guy told the waitress he not going to eat. So, the waitress ok. The dish was served and the lady eat the dinner. But, she cant finish and full and at last passed the leftover dish to the guy to finish.

Referring to above situation, the couple was said to break the contract. As contract had been formed once the waitress highlight the " minimum one dish per person".

Question:
1. Can the boss sue the couple to the court? If yes, can the customer win the case? or the restaurant's owner will win the case?

2. What will be the penalty be given?
