My sales and purchase (S&P) dated on 15 January 2016.
1) Liquidated Ascertained Damages (LAD) is calculated until which date? Date of receiving the Vacant Possession (VP) letter? or date of developer sending out the VP letter? or the date until I get my key?
2) My case very complicated. Their VP letter dated on 10 April 2019. They sent out the letter on 18 April 2019. I received the letter on 7 May 2019. I got my key on 17 May 2019. And there are lots of defects in my unit. There is no water supply in the unit until today.
3) Liquidated Ascertained Damages (LAD) on common facilities. The swimming pool is not ready for use until now, The water is dirty and they have yet to fill up the pool until full. Their Certificate of Completion and Compliance (CCC) letter is dated on 10 April 2019. But with this kind of situation, can I claim the LAD on common facilities until they done the job? or need to follow date of Certificate of Completion and Compliance (CCC) letter?
4) Developer said they need another 30 days to do my unit defects. But they only agree to pay LAD calculated until 10 April 2019 for common facilities, and 9 May 2019 for LAD of unit (because their Vacant Possession letter dated on 10 April 2019, so they said must get key within 30 days).
