My student visa expired and I overstayed.

I am a Libyan student. I graduated recently and my student visa expired on 2nd of June 2018, and because I am still working on unfinished research papers with my supervisor. I contacted the university international office and ask them if I can get special pass for one month to finish my work, they reply that I can apply for special pass, just that I need to bring the passport with a flight ticked leaving within one month.

Later I went to Kuala Lumpur to stamp and verify my certificates, my back pack was stolen and my old and new passports were inside (luckily I have copies of them both). I made a police report and also contacted my embassy regarding what happened.

Before my visa expired I contacted the international office in my university and they told me I still can apply for special pass one moth, I need to bring the temporary passport and also the police report and ticket leaving within one month (my flight leaving on 29th June 2018). I brought all these documents few days before my visa expired. Then few days later the international office in my university contacted me to tell me that my request has been rejected by the Immigration. Now I am overstaying for few days. The problem is my country is not stable and not all airports are working and its not easy to find flight ticket within 7 days, I tried to change the flight ticket I had which is leaving on 29th June but there is no flights within 7 days.

What should I do, I don't want to be in trouble, I have been here in Malaysia over 5 years studying with out leaving the country. Please any advice and thank you so much.

Where is the temporary passport now? Why need to leave in 7 days?

Hi Mr Jeff

The temporary passport is with the university international office. Its a travel document which is valid for 2 months and only to go back to my country, as what they told me at the international office, I have to bring a new ticket leaving within 7 days which I couldn't manage to get it. My flight ticket is flexi but the airline they don't have any flight within 7 days so I can't change it, so they told me if I overstay more than 7 days then I have to go and meet the Immigration enforcement as they will ask me few questions related to my overstay and then I have to pay compound for the overstay days. Also they will give me 2-week pass as I have to leave the country within these 2 weeks. If this is the case I am okay with that.

Go today to that stupid International Office and retrieve your temporary passport. Bring copies of your old passport, police report, image of student pass.

Then go direct to Immigration by yourself to apply for an extension based on:

1.  There is unrest in your country which may compromised your safety by going back now.
2.  You show your pre-purchased air ticket and mention flights are irregular and can be changed.
3.  Immigration may issue a "Special Pass" for 30 days. Before the end of this 30 days, if you really could not go back, another 30 days extension can be granted based on any "unrest" in your country. This SP is for special cases. No Immigration will send you back to an "unsafe" place of origin.

There could be flaws in the application.  Valid Student Pass can apply for 30 days extension based on uncompleted coursework and/or studies. This is stated in the Immigration Website.

Is the new temporary passport number stated in the Air Ticket purchased? If based on old passport, cannot enter the Airport or even get a boarding ticket.

Thanks a lot Mr Jeff for making it clear for me. Actually I just graduated recently, so it means this is my last visa as student, which expired on 2nd June 2018. I don't know why my application has been rejected, but may be because I already graduated, and the international office didn't explain why my application is been rejected. Any way thanks a lot and I will keep you updated with what happen to me.

I wasn't aware of that, actually I wrote the stolen passport number when I booked the ticket online.... inside the temporary passport is mentioned the stolen passport number which I use in the booking. I still can change the ticket details. Should I put the temporary passport number? The only issue is temporary passport number is a bit different, is more like a reference number something like this 034/2018. I try to change the flight details by entering that number, but the format was invalid so I just enter it 0342018 with out the slash... do you think is that okay?
