Overstay more than 2 years

I'm a Malaysian. Having illegitimate daughter (1 year old) with my partner whom he's from Nigeria. 

My partner has been overstayed for 2 years now since his student visa expired. His passport expires in 2022. We plan to marry in September in Nigeria and he will follow me back to Malaysia.

Q1: Can he leave the country in September? 
Q2: Can he come back with me after we marry in Nigeria?

Q1: Can he leave the country in September? 
Of course can. But after he has completed his jail term and whipping.
Go surrender now before 30 June 2018.

Q2: Can he come back with me after we marry in Nigeria? 
Of course can. Can come back after the Ban period.

A marriage is not a passport to come to Malaysia after there are Infringement of Immigration laws. There is a proposal that after 30 June 2018, the ban is 10 years.
