Online Maid System: Registering my maid who has overstayed in Malaysia but was rejected by the system

I understand from the recent news media that an employer can now register their prospective maid via the Immigration online system which includes foreign maids who have overstayed in Malaysia between January 1 to December 31, 2017.

I tried registering my maid and when I insert my maid’s passport details in the system, a pop-up message will appear with the message, “Gagal meneruskan transaksi ini kerana calon TIDAK MEMPUNYAI MAKLUMAT PAS. Sila rujuk Jabatan Imigresen Malaysia untuk makluman lanjut”.

From my maid’s passport, it appears that her social pass has expired on 26 March 2017. When I first received my maid from Indonesia, I have already paid my agent for all the charges including getting a valid employment pass for my maid. Unfortunately, despite many reminders my agent has failed to get the pass and he is now avoiding my calls.

Since now that Immigration Malaysia is allowing maids who have overstayed to be registered subject to a compound (according to the newspapers), I will not want to depend on my agent anymore and just wish to make this right.

I suspect that the online system has rejected my attempt to register my maid because she currently does not have a valid pass and I will probably need to resolve this first.

I would appreciate it if you can advice me how I should approach this without risking my maid being deported because of the overstay. Thanks.

Since you are able to find hire a maid online are you aware that you can be fine RM10000, a Jail Term, Canning (plus blacklisting as have been a jailbird) for harboring an illegal? Saving your own skin or her skin?

Not accurate. You should have bought her to directly to the Immigration to apply before the 31 December 2017. The current online application should have the same issues as the MyEG applications.

My suggestion, one and only one:

Send her back!

The above article that I read regarding the maid online was correct as the procedure to legalise maid who has overstayed since last year, subsequently appeared in the Malaysian Immigration website. I went to see the Immigration Officer of the Enforcement Department and they issued a one month special pass for my maid. I only have to pay a compound of RM400 although my maid has overstayed 10 months i.e. since March 2017.

With the special pass, I managed to continue with the application online and Immigration has just issued a Pas Lawatan (Kerja Sementara) of 12 months for my maid. With this, for those who has a maid who came to Malaysia with a social pass which has expired last year, please go use the new immigration system i.e. Maid Online to legalise your maid. This amnesty given by the Immigration is only until end of June 2018. In total I only paid less than RM2,000 which includes the compound, processing fee, multiple entry visa, single entry visa, deposit, levy etc.

Thanks for posting your experience, its very useful for people like us who are trying to legalize our maids who have overstayed.

I have a maid who has overstayed for about 1.5 months (she came on 23rd Jan 2018) and started to work for me on the 9th Feb 2018. She came on holiday visa but that's only valid for 1 month. We were suppose to have her for "trial" and now we would like to legalize her, the agent wants to charge me an additional RM 6500 as he says that we need to pay undertable money. I have already paid in total RM 12k to him just for the biodata... therefore I do not wish to fork out anymore money to these unscrupulous agents. 

My questions are:
1. You mentioned special pass expired in 2017. Did they change any rules for maids which special pass expires in 2018? Because that's what my agent is claiming. He says that he is not able to continue with the application online because she overstayed and I would have to do it manually (with more cost) as undertable money is expensive. He says they changed the rules. Do I only have time till June-18 to apply for the one month special pass?
2. Do you have a thorough breakdown of what you paid for in that RM2k?
3. What type of documents did you bring with you to the immigration (Enforcement Department) to issue to one month special pass?

I have a case about overstay. I have already paid my compound overstay in Malaysia to become legal in Malaysia by applying for a permit to work by applying for a maid online January 2018 but because my employers are not married so the Immigration does not agree to continue my work visa. They gave me a special pass to return to my country. So I have to go home before 30 days, because employer does not meet the requirements they suggest that my employer get married to meet the requirements. Finally, my employer decided to legally send me back to my country without being blacklisted by Malaysia with a letter from immigration of course. Therefore, I reached my home country normally without any problems.

However, I have a mother and stepfather in Malaysia. My sister has a Red IC in Malaysia because my stepfather is Malaysian. I have long story and the reason why I overstayed .. I also have a boyfriend in Malaysia, of course I want to meet them one month after I returned to my country. I brought enough money for everything. They were ready to pick me up at the airport but at the Immigration they did not allow me to enter and stamped my passport NTL.

I haven't returned to Malaysia for 5 months because I was afraid about the NTL stamp. So sometimes, my boyfriend visits me in my country. We have plans to get married in Malaysia but I'm still too scared to enter Malaysia because I am afraid to be questioned by the Immigration when visiting other countries. I plan to renew my passport because this is disturbing even though I knew that this has no effect in other countries.

Will I be able to enter Malaysia to register for marriage as usual? ...I will be entering using a social pass visa with a new passport but all identities remain with me just like extending the passport.

@Inez, what is NTL? I have a problem here. My pinoy maid has an expired tourist visa 24 April 2018. I've called the enforcement at Putrajaya, they asked me to pay compound of RM2100, issue a begging letter to appeal them not to blacklist my maid. And my maid has to be deported after that. At least 3 months then only she can come back to Malaysia legal. I haven’t done anything yet.

Yes, correct. There is Compound Fine, Overstay Fine

At least 3 months then only she can come back to Malaysia legal.
Wrong.. The ban is for 5 years at current policies. She is treated as an illegal now. For Maid applications, there is a window period of 30 days overstay allowed for the application of the work permit. Beyond that no more allowances.

The only solution
1. Give your maid the monies to pay for all the penalties.
2. She goes to the Philippines Embassy to seek help to be repatriated with the help from the embassy. She goes to the Immigration direct by herself, she will be sent to Detention Camps and will be charged at the Immigration Court, jailed for at least 6 months (or fines in lieu of Jail term).
3. Send her back before she is caught in immigration raids and YOU go to Jail plus heavy fines for harbouring and employing an illegal.

As at to date, more than 1,200 illegal employers have been charged in immigration court.
