I would like to get an opinion regarding unauthorized access of business computer by employer without the staff knowledge e.g running background auditing software without user knowledge and also spying on internet connection of staff. Results from the auditing and traffic are then shared to the boss without the staff knowing when is the time that ICT department conducted the audit on the computers.

My question are:
1. Are there any clause in computer crimes act that can be used
2. Are there any law which can be use like exemplary damages?

Thanks.

There is no unauthorized access as the computers belonged to the company.

If one does not not abuse company time and resources, why worry?
