I was made redundant by my company on 2 Oct and were given a notice period until 27 Oct due to company is closing down.. reason given was we have a 4 weeks noticed period given. While the existing leaves is advised that it has to be taken within the notice period of 4 weeks and can’t be converted to $.

I’m drawing a monthly salary of 5 figure in the management role.
I was advised that I will be getting a severance pay of 1 month, with a prorated salary until 27 Oct for month of Oct.

Appreciate for some expert advise in regards to this questions:
1. For a 11 years of service while drawing a salary more than RM2K, may I know what are the notice period under employment act in Malaysia?
2. May I know if October prorated payout is fair ?
3. Under scenario of company closing down, is it arguable that the accumulated leaves could be made as payout?

Many thanks in advanced.

Notice period is an agreement between employer and employee, what was agreed in the terms of employment.  It is not set by law.
