Car parked at shopping mall damaged. How to file a claim?

Last march, my sister went to IOI Mall Puchong and parked her car at the basement area. It was then raining heavily about 1 hour. When she returned to her car, the car park area was flooded and all the cars there were halfway sunk. No announcement was made during that time, so she was not aware that it was flooded. She then has made a police report regarding this, and had send all related documents to IOI management office to claim due to their failure to notify visitors on the flood. Her car was badly damaged and could not be use anymore and needed a major service replacement. From March till now, there was no reply from IOI Management. The car has been sent to Proton Service and has been evaluated for the total repair cost.

Please advise on what can we do to claim from IOI due to their negligence.

Did your sister talk to any lawyer about suing IOI Mall?
What did the lawyer say?

@vkpc,

No, not yet. She has already lodged a complaint with the IOI Management and sent in all related documents. So far, they have been very quiet and no reply. We have yet get in touch with a lawyer. Do not know whether can sue on this issue.

How much did Proton estimate the repair cost to be?

Did your sister see any "Park At Your Own Risk" signs at the mall car-park?

Estimation cost of repair is RM22,000. Not sure on that.

Since the claim amount is less than RM 25k,
you can sue IOI Mall Management at Consumers Tribunal in Putrajaya.

At this Tribunal, both sides are not allowed to use lawyers.
