Bankrupt - How To Apply to Work Overseas (Yearly / Periodic )

As a Bankrupt who has reported in to JIM and is under the Case Management, one can apply to Jabatan Insolvensi Malaysia (JIM) to travel overseas for work purposes. They are three main types :-
1. Working overseas already
2. New application for new job overseas
3. Application for occasional travel overseas for Business / other purposes.

A kind Bankrupt / forumer who has been working overseas for past 1 year have just renewed his Travel Pass  last week had informed me about the current conditions imposed by JIM.

The conditions are :-

Take note that this case is already into the second year and is paying monthly of RM300 to JIM. The P.O.D. amount is RM300,000++ There are more than 2 POD Creditors.

The conditions are :-

1. Provide a Guarantor. The Guarantor have to pay a deposit of RM1,000.
2. Credit into the estate of the bankrupt of RM3,000  Non refundable plus travel to one country only (Multiple countries available - pay 3K per country).
3. Making advance payment of 2 months (2x300=600).
4. The Guarantor have to ensure all monthly payments is up to date or the RM1,000 is forfeited.
5. The Guarantor have to sign an undertaking that all payments is paid promptly during this period of work overseas by the bankrupt. (in short, the Guarantor will make payments).
6. The Bankrupt have to submit the 6 monthly Income and Expenditure Statement promptly.
7. The Bankrupt have to update JIM of up to date address with fail.
8. The Bankrupt have to give permission to JIM to access his/her Tax account.
9. The Bankrupt have to give permission to JIM to access his/her EPF account.
10. Any failure to the above conditions will result in the forfeiture of the RM1,000 Deposit.

Other Notes
11. The Bankrupt is given 1 year Exit Pass validity.
12. All documents is signed (including the Guarantor) in the presence of a Commissioner of Oaths.
13. After all the monies is paid in CASH or Bankers Cheque, the Travel Pass is only issued.
14. JIM provide all the necessary standard forms to be submited.

Hi Jeff,  

Currently I'm bankruptcy and stay in overseas now, my passport is still valid. I'm  just wondering after they implant the new rules for bankruptcy to clean the name after 3 years. Should I go back to meet with JIM for the first interview ? And apply to work in overseas at the same time? 

As the forms to fill in before the interview , it mention if I have valid passport I have to surrender it to JIM. My concern is will they denied me to exist malaysia and  took away my passport if I denied to surrender?

If your passport is still valid, it will say TIADA HALANGAN

Thanks for your response.

My passport is still valid until 2019, I went oversea before the brankruptcy filed.  Now I'm not working and I have 2 kids.

Currently I'm still in overseas(Asean) . I already have the notice in the newspapers and received the file no of brankruptcy . My brankruptcy filed less then 2 years.

As the rules of brankruptcy changed and i saw in the news paper that we can clear our name after 3 years.

I made appointent by email to meet with person in charge in insolvacy in july, but first I have to fill up the forms before interview with JIM. 

In the form there is a page mention about passport : a) adalah anda mempunyai passport antarabangsa (passport hendak diserahkan ). 

At first i am thinking of going back to Malaysia to meet with JIM and also summit the document to apply to work in overseas.

While waiting , I will go back to overseas by land . But if I surrendered my passport I can't exist malaysia anymore. And not sure if they can approve my request of going oversea to work . Is that risky to go back to if I do that ? Because that passport is my only way of from malaysia 😅

Notes
1. A valid passport does not mean you can travel overseas out from Malaysia. If you are overseas already, you can travel from one country to another for those visa free countries.

2. For new application to work overseas, there must be offer letter from overseas employer. There must be tax clearance from the Tax Dept.

3. The 3 years discharge refer to after reporting in to JIM, a bankrupt have to do a CASE MANAGEMENT with JIM for 3 years before making an application for discharge subject to the consent of the creditors. It is not a 100pc successful discharge.

4. Bkcy laws require you to submit husband and children legal status. Is yr marriage registered in both countries? Are the children citizens of Malaysia?

5. Which overland country you are in now? Thailand or Singapore? There is nothing scare to tell. Have you obtained residency. In these 2 countries, if not, you maybe breaking immigration laws of these 2 countries. Even if you get permission to exit Malaysia, you may be ban from entering those countries.

6. Bkcy Laws requires you to surrender yr passport to JIM once you have reported in. It does not matter if you do not surrender it, it has been bar for overseas travel.

There are more other issues in your case and actually very brief info from you. By what you have written above, your application to work overseas have big issues. Btw, for renewal in second year, there is a requirement to have a valid working permit in that country you are in for taxation purposes.

Your passport's validity is until 2019 but if you are already declared bankrupt, they will blacklist your passport. If you are going out of Malaysia, they will stop you at the immigration. Not sure what happen if you are coming back, maybe they will take away your passport upon arrival. But definitely, if your name is blacklisted, you will not be able to go out of Malaysia.

So just check online and see the status. If you are bankrupt it will say something like 
SILA RUJUK KE JABATAN IMIGRESEN TERDEKAT.

which means that you will never get pass Malaysian Immigration.

If you come in by air and go to the auto gates, it will not open and will direct you to go to the counters with officers. There they will tell you that you will be ban by who and who  and go to the agency that ban you. Your passport will not be taken at the immigration unless for exceptional cases. In any case the immigration will give you an acknowledgement letter.

My case of bankrupt is in Johor Bahru, But I try to call up and email there is no response. What is the alternative way to contact the officer? Cause I'm staying in Kuala Lumpur.

Can you please advise? Thanks an advance.
