Surat Dikehendaki Menghadiri Mahkamah (Bankrup)

Assalamualaikum.. Salam Sejahtera.. 

Mohon jasa baik Tuan/Puan yang arif didalam forum ini untuk membantu saya untuk lebih faham mengenai surat dan tindakan yang perlu saya ambil. Surat ini adalah susulan dari tunggakan hutang saya dengan pihak SCB bank. Tunggakan ini kerana masalah diberhentikan kerja pada 2009. Pada 2012 saya cuba settle di Standard Chartered Bank (SCB) tetapi tidak dilayan dan disuruh deal dengan Aiqon.

Saya sudah cuba beberapa kali dari 2012 hingga kini untuk settle tapi interest yang dikenakan terlalu tinggi. Saya tidak mampu.

Saya pening memikirkan hal ini. Ada sesiapa yang biasa deal dengan Aiqon?

soalan saya adakah saya perlu hadirkan diri dan apa yang perlu saya lakukan kerana sepertinya saya akan dikenakan perintah bankrupsi.. mohon berikan pandangan untuk saya..

Berdasarkan pengalaman di forum ini, hanya Bank SC sahaja melakukan amalan menjual hutang nya kepada pihak ketiga. 

Untuk tujuan ini mereka harus mendapatkan perintah '' Vesting Order '' terlebih dahulu dari mahkamah. Pastilah mereka sudah berbuat demikian jika tidak masakan mereka boleh membawa kamu sehingga ke peringkat kebankrapan ini. Kamu juga sepatutnya di beri notis mengenai perkara Vesting Order ini.

1. Sebagai persedian kamu menghadapi kes ini kamu harus lah mempunyai segala Dokumen dan Perintah mahkamah yang telah di failkan oleh Plaintif atau Pemiutang Penghakiman terhadap kamu. 

2. Baca dan fahamkan sedikit sebanyak mengenai undang undang Akta Kebankrapan dan prosidur nya. 
Banyak info boleh kamu perolehi  jika kamu rajin menyelak muka muka surat (threads)  dari kes kes yang lepas di forum ini.

I have always pointed out there is always a "TRIGGER" in the banks actions to bankrupt an individual. In your case the trigger is your name in a property.

It is not normal for debt purchase agencies to file for bankruptcy unless they are very sure that they can get some moneys back successfully. Your housing loan should be up to date and would have a major "surplus" after any "auction/action". Hence they come for you.

Go to the Land office, do check if Aigon have put a "caveat" on your property using the Perintah Perhakiman. Overseas creditors does it. Check first then think of a solution. Aigon is not really interested in your property, these type of companies just want to force you out to pay what they have invested in buying over the debt. There are rooms for negotiations.

My suggestions
1. Delay or set aside this N.K. if there is a chance
2. Meanwhile depending on the circumstances in the housing loan, do consider liquidating this property before any bankruptcy for maximum returns. There is a thin line between losing this property due to being bankrupted and remain a bankrupt AND losing this property with max returns but not bankrupted.

Time is short, start your work today..!! There is a chance to get out of this predicament if circumstances favors you...

No. The limit is 10 images per day

Per post is 3 images.

But any failed uploads is taken into account.
