One of my friend is now in Malaysia. He went there on a multi entry tourist visa. After he reached Malaysia, one of his friend who is doing visa works in Malaysia promised him that he will clear his EP visa. His passport is now with his friend who said that he can't clear his visa and did not give him back his passport. Now my friend has overstayed for more that 2 months.

My questions are:
1. If he cannot get back his passport, can he approach the embassy for a one time emergency certificate to travel back to India?
2. Can he approach the Malaysia Immigration to surrender himself and get back to India?
3. And if he does so how much will be the fine amount?

Please help my friend who is in critical situation now.

Answers to your questions:
1. Yes
2. Yes
3. RM30 per day overstay.

PLEASE ask your friend to go back to India and post on India social media that:-
DO NOT COME TO MALAYSIA TO FIND JOB ON A SOCIAL VISIT PASS. USE AUTHORIZED AGENTS THERE.

1. There is NO EP VISA to apply while in Malaysia. Any "Approved" work permit is likely to be false.
2. The Multiple Entry Visa is for tourists, not for applying for jobs and it is 30 days per entry.

Go to your Embassy and register.

The Amnesty should still be on.

Hi Jeff005,

I have 2 Filipino friends now in Malaysia. They arrived last February 16, 2017. While staying for a tour someone offered them job in a restaurant so they planned to do exit to Thailand days before their social visit pass expired, but the agent said their visa will not be processed if they do exit. They need to be overstayed in order to process and register them to rehiring program. They believed and now they are 2mos overstyed and no visa until now even they already payed initial payment to tge agent. The question was, is it possible for them to get visa even they are overstayed like what the agent said ? If ever they will just go back in Philippines, what can they do and how will they need to pay ?

@ dolly

I do not understand why ppl are still being cheated by so called "Agents".

1. Overstay is overstay. No chance given.
2. Rehiring program is for RE-Hire, that means for those who had a Employment Pass which has expired plus expired visit pass.

They need to be overstayed in order to process
These Baxvx@##$$%^&*()s are lying thru their contaminated breath. These ppl are Filipino or local agents? Only TUHAN knows how much moneys they have conned and the number of Passports they have directly or indirectly destroyed. A Pino should be involved or else it would be not convincing enough for the SCAM to be successful.

If ever they will just go back in Philippines, what can they do and how will they need to pay ?
Go seek help from the Embassy NOW. There is an Amnesty on. Pay RM400, get EXIT PASS, and go home safely.

They are not just 2 who has been believing in rehiring thing . They said many filipino working there with the same agent,he's said to be a chinese agent .
The Amnesty was until when and would they be banned from coming back in Malaysia even they willundergo proper and legal process from agencies for
 employment in Philippines ?
How about "Special Exit Pass" is that real? They are told to pay and have their passport chopped for an extension of visa so they can exit and go home without being banned..

Pls check direct with the Embassy

would they be banned from coming back in Malaysia
Definitely a Ban. Immigration Travel laws have been broken.

How about "Special Exit Pass" is that real?
Of course it is real. It is special because it is a one way ticket home.
The correct term is just EXIT PASS.  It just cost RM100.
UR "Special" to me cuz I tell u so much things.

They are told to pay and have their passport chopped for an extension of visa so they can exit and go home without being banned..
They came into Malaysia on a FREE VISA (Single Entry) FREE SOCIAL VISIT PASS (30 Days). How to have extension? Extension of another 30 days was possible in the olden times, but i not not sure nowadays AND that is on a PAID VISA  not on free Visa.  It is just bogus agents (previously authorized agent being struck off the list) scamming, conning people.

Once you give them your passports, you are virtually at their mercy. All sort of lies and stories to con more moneys will come out from their dirty mouths. I have heard stories of extortion of up to RM3-5K just to get their passports back.

@ dolly (cute id)

There is a M.O.U. signed between the two countries with regards to foreign workers into Malaysia. Agents have been appointed on both sides. There is no short cut by coming direct here to find jobs.

Tell your 2 friends to go home and spread the correct procedures. Do not be con by bogus agents.

Brief Process
1. Employers thru approved agents in Msia will send requests to approved agents in THE Philippines.

2. The Pino agents would advertise or thru word of mouth.

3. The agent will collect and submit the applicant BIODATA and send it to the prospective employer. Once approved, the agent here will notify the other side.

4. The agent over the other side will would prepare all documentations which will include Passport and Visa. And a very important Medical Report conducted in home country.

5. The employer in Msia will pay and fly the applicants over here.

6. A compulsory Local Medical Report under FOMEMA have to be done immediately to be submitted to Immigration for Approval. All these must be DONE within 30 Days upon arrival. If there is delay, only then an Extension on the social visit pass can be applied for.

Pls.. pls.. pls.. spread what I have written to you on the Filipino's social medias.
Tell the agents there to come over to Msia to sue me in a court of law if I have written nonsense above  When I write the truth, people do not believe as this is not what they want to hear. When bogus agents say "can", they jump for joy and come up with moneys, to be conned, scammed.

Such is Life
Life goes on anyway (for me)
