CCRIS report tak appear rekod pinjaman kad kredit

Saya baru terima Laporan CCRIS dari Bank Negara Malaysia (BNM) untuk membuat permohonan AKPk. Saya mempunyai 2 loan:

1) Citibank Credit card
Kredit limit RM4,000 (lebih 7 tahun tak bayar)

2) CIMB (kereta dah lelong baki RM15,000)

Dalam report CCRIS, cuma ada CIMB sahaja. Pihak BNM minta saya call Citibank untuk tanya status loan credit card.

Soalan saya: 
1) Kenapa loan kad kredit saya tak appear dalam rekod CCRIS?
2) Haruskan saya call Citibank?

Yes.. you are a Judgement Debtor.
Case no
72NCC.

Reply you tommorow.
This month do not pay yet.
Will give you options on how to repay.

Pls try to reply my above questions.

U have receipts for the 3 payments to CIMB? 
Yes i have. 

Why you decide to go AKPK? 
At 1st, i would like to pay my CC and cimb loan..so that i can pay lesser for both loan 

Can you afford the repayments? 
If below RM200.  I am housewife and i do a small bisnes from home.average income around RM700. 

 Can you afford the monthly RM500? 
Definitely not. My h/p loan monthly is RM460 (bfore lelong).  

The bank rep should be a bill collection agency. Did they threaten you?
Yes,they are DC . I think she is from Rohani bla bla (after installed who calls apps).  She is very polite. 

 You paid direct into CIMB. Can you describe to me how you made those payments? 
Pay thru CDM. She give me the acc no (Cimb  has changed the new acc no) but the acc belongs to my name. I had tried to press under my Car regis number, my name appear.  

Your car loan ac has been closed. How did they activate banking in? 
I dont know. 

If you have dealt direct with CIMB, I will hands off. If it can be confirm they are bill collectors, I can teach you how to deal with them in the future.
Pls advice me. 

How about my cc loan?

Further Q's
1. Your Summons 72-2986-09-2012, did you attend court? Did CIMB send you the docs for this court case. I need to see the "tuntutan" (Statement of Claims). It may contain critical info for you. Use this case number to extract records from Ipoh Magistrate Courts.

2. Did CIMB ever send you the details of the "lelong", need this docs too.

3. You can forget about Citibank. There is no records of lawsuit in CCRIS and CTOS. If from now onwards, they file a lawsuit, you can use the Limitations Act of 6 years to set it aside. Provided the address in the bank records is the same as your current address so that you can receive courts docs.

4. Tomorrow I shall write what CIMB can do to you since you are a Judgement Debtor. 

5. You could have been made a Judgement Debtor on 07-09-2012 with the amount 15.2K. Today at 13.04.17 would be much more, depending on the interests element in the tuntutan in the samans. I need the interests rate element to compute some critical figures

6. How much did the bill collector try to claim from you?. Quite sure it is not 16K. After the 3 payments, did CIMB send you any statements. If the bill collector calls you these few days, delay and request for the latest statement of acs.

No. The address is my parents house and we' re moved to new house on 2011. 

2. Did CIMB ever send you the details of the "lelong", need this docs too.
No.

The debt collector told me my current debt is RM17K

6. How much did the bill collector try to claim from you?. Quite sure it is not 16K. After the 3 payments, did CIMB send you any statements. If the bill collector calls you these few days, delay and request for the latest statement of acs. 
No any statement from CIMB till now..already update my current address to DC.

You could have been made a Judgement Debtor in 2012. (JID awarded to the bank)

The next course of action the bank can undertake to secure legal orders from court, from 2012 onwards are :-

1. WSS Order (on fixed assets like cars, assets in the house belonging to you)
2. Granishee Order
3. Prohibitory Order (on land assets)
4. JDS Order (Summons you to court)
5. Bankruptcy (last resort) when the amount exceeded 30K. (50K soon, maybe)

Google on the highlighted keywords to understand better. Google from this forum search function.

1,3,4,5 is unlikely to happen to you. That is my personal opinion/view.

There are several issues unsolved in your case.
1. Is the lelong value of the motor vehicle included, rather deducted from the outstanding amount in the saman tuntutan. Please tell me more on how you defaulted on the car, market value, number of outstanding instalments, type of car, age of car, etc, etc.. you surrender the car to them or was repossessed?

2. The interests element that was awarded in the JID. (Judgement in Default).

3. Was there a Guarantor?

4. Brief info/intro of your personal lifestyle. Then decide on whether how much the BC can harass or intimidate if you discontinue the payments. Not working how to pay? Why not working?

At this point of time, do not pay the April "installment" to the BC or CIMB.
Plan your next course of action. My above Q's will and can determine the next best course of action for your case.

 if im not wrong my loan balance bfore lelong  was RM22K. Loan for 9years (Mar 2007  to feb 2016).  after married im not working due to pregnancy prob during that time and until now.Now I do a small bisnes from home. Average income  is RM700.

The car was proton Savvy.
After resigned, my sister continue to pay the car loan. The car was repossessed somewhere on mar or Apr 2012..

Mother of 2kids.im not a kaki shopping,  kaki travel.most of the time im at home. 

Then decide on whether how much the BC can harass or intimidate if you discontinue the payments.
I didnt answer call from unknown number. So i didnt get any harass from BC. But starting from my january payment,i always received call from BC number on every 24th and 25th for this 3month.

Not working how to pay? Why not working? 
I resigned due to pregnancy prob.  after husband not allowed me to work.

At this point of time, do not pay the April "installment" to the BC or CIMB. 
Plan your next course of action. My above Q's will and can determine the next best course of action for your case.
Can i refer to AKPK.? Fyi,i dont have any aset under my name.
