Self Represent At Court To Fight Affin Bank

Purpose of this thread is to share court experience in my FIGHT with AFFIN BANK on credit card debt.

My original debt = RM9k.
I was served bankruptcy notice (Amount  RM77k) in 2015 thru substitute service.

I took the fight since then (already more than 1 year from date of noticed served). Throughout this period, i have attended court not lesser than 30 times; including attend case management, filing documents, file searches. TODAY, I AM STILL NOT A BANKRUPT PERSON. 

FYI, I am a layman. Cannot be more layman than layman.

End of 2016, the PKP rejected my application to set aside CP.
I made an appeal. Now the case is pending for decision by Judge in Chamber.

There is nothing personal between Affin Bank and The Avengers.
All are mere coincidences. It happened that those who came for help in this forum are AFB related debts. There are thousands of debts cases in court everyday..!! Every bank is involved.

The "Fight" reproduced / documented here is with the permission and participation of the Judgement Debtor. Many others do not want it to be documented here for fear of loss of "muka". There were other documented cases involving other banks if you care to read backwards the past 4 years.

The lines are clear
1. Pay what you owe legally (not the exacerbated amount and ridiculous penalty charges)
2. If cannot repay then don't take loans (bank's fault too)
3. If debts too high, be bankrupted (no qualms)

But what is happening, a lot of cases, is that people have made Judgement Debtor, Bankrupted without going the complete legal process. Notices is seldom send out correctly, some debtors wants to nego but banks do not want to, sending Bill Collectors who acts like thugs, yasukas, mafias, geng 24, thai assassins. Harass and intimidate family members, at workplace, simply threatens everybody even for small debts, masquerade calls as Mahkamah, IPK, Polis, Immigration.. etc etc (leceh to write out all). Calls from Datuks, Datuk Seri, Datins.. what d ****, bring political figures into the legal system? Politics and the legal systems do not mix.. Then a new trend.. sy Haji xxx... sy Hajjiahxxx...  LOL..

People are also bankrupted even when their debts litigation period have exceeded the 6 Years Limitation Period. Are the banks or their lawyers behaving appropriately, professionally?

If the Banks and their lawyers are doing their job properly, do you think The Avengers can set aside the lawsuit? "We" are just helping those in need who cannot afford the expensive lawyers fees. There are some who are really poor and some may not, but who are we to judge and how to screen?. We just try to help those who come to this forum for advice and help.

Everything is fair and square to either side.. no victimization of any party.
Be patient, other bank cases is coming out by the dozens. Soon... very very soon.

The Avengers is just performing (Corporate) Social Responsibility. It also happened that some members had been (unjustly) served with faulty Lawsuits.

Normally for a straight forward case is verdict in 2 weeks. Hearing n 10apr 2 weeks later is 25apr. But this complicated case it is taking 1.5 months... hahaha

Y so anxious about @kunta case. U gf?

Hi Kunta,

The Oracle at the Avengers HQ has calculated your chances of winning this case at 65%.
After the decision is pronounced by the High Court judge, the next fight will be on costs.
Are you prepared to argue against the bank lawyer on how much costs should be paid to you by Affin Bank?

the judge missing in action. therefor nothing happen. what a strange legal system we have here.
