My 1st car was sold to other as 'sambung bayar' on 2012. Then that buyer lost contact and didn't pay the installment. Lost contact with the buyer since 2014. Bank called many time asking me to settle the outstanding. Since January 2015, I pay the installment even the car not with me.

I also received 'writ saman' and was asked to attend to court but I didn't attend. What will happen if I didn't attend?

In March 2015, the bank auctioned (lelong) the car. Total outstanding I need to pay lumpsum is RM20,000 but I only paid RM400 - RM500/month. Recently I received a SMS 'tawaran pembayaran penuh hampir tamat' then I called my debt collector, she said bank gave offer to fully settle this month at RM8,5000 or RM9,000 within 2 months. Balance outstanding now RM12,000. Is it true bank made such offer?

The agent also said if I take the offer and pay, my name will clear from Bank Negara Malaysia (BNM) blacklist after 6 months. I need someone to clarify on this.

If the car already lelong, anything happen to the car who will be responsible? Because I checked polis saman of the car. There's 1 saman on 21 February 2017 but in Kota Kinabalu (just wonder how can someone bring that car out of peninsular).

If lost contact, how come the bank can lelong the car?

@ Rose

You still have the lelong papers?
If the car is still under your name, you are still responsible.
Any negotiations should be direct with the bank, hitam putih. Don't go thru agents.

These are the issues of "sambung bayar".
It has nothing to do with the illegal buyer.
