What To Do if I have been made a Bankrupt 6 years ago

Hi Jeff,

I hope you are in great health to begin with and certainly appreciate if you could advise me on my current predicament.

Recently on 16/2/2017,I received a SMS telling me my credit card debt (xxx) is in the process of legal proceedings and the sender prompt me settle out of court. I believe the bank had my case assigned to a collection agency (xxxxxxx straits co) years ago with the initial debt of RM20,000+ but by now, only heaven knows what they are claiming. I have not reply nor spoken to anyone from there thus far. Should I go meet with them to discuss further?

By the way, I am already made a bankrupt by another bank in 2011 but only found out my status in October 2016 when I apply for a savings account. Further check with Immigration website also reveals negative answer..di larang keluar.

I am not with Jabatan Insolvensi Malaysia (JIM) either. Is advisable to register with them now? Will I benefit from the 5 year auto discharge if the bill go through this March 2017?

Are the collectors from xxxxxxx straits playing poker with me to get some money. I am sure by now they are aware that I am already a bankrupt.

Your advice is much appreciated. Thank you.

What to discuss? You are a bankrupt already (but not reported in yet)

Is advisable to register with Jabatan Insolvensi Malaysia (JIM) now?
Depends on
1. Age
2. Health
3. Employment Status
4. Ability to pay to JIM
5. The need to travel overseas to visit your roots.

Will I benefit from the 5 year auto discharge if the bill go through this March 2017? 
There is NO AUTO DISCHARGE, whether here Singapore or even Australia...!!
The Bill is about reducing the number of years of case management with JIM for Malaysia case. Still have to apply for Discharge in the High Court. (Australia is slightly different only)

I am sure by now they are aware that I am already a bankrupt. 
Not true. They may not be aware of it. Or they could have.

To file a bankruptcy notice, the bank has to check with JIM first. If they (bank) have not made you a Judgement Debtor first and had no intention to bankrupt they MAY or NOT know. OR they just Buat BODOH and their agents will try to scam some moneys from you. Or maybe they are hoping for you to discharge yourself then make you a bankrupt again.

The issue is that you have not reported in to JIM, how can the other banks file Proof of Debt?
You do not have an Active file in JIM opened yet.

The 5 years Case Management with JIM starts on the day you reported in, NOT bankrupted date.
