I would like to know if the company can sue me by not paying the penalty amounting to RM3,500.

The company can blacklist you at CTOS if they have corporate account there. As a result, banks will hesitate to given you loans or credit cards. Defaulters of any kind is nowadays frowned and looked down upon.
