Old study loan with mara

Hi I have an inquiry here regarding study loan with mara. I was hoping for advice or at least give me some idea so that I can understand the legal procedure.

The balance of my study loan 5k++ but to clear the guarantor name from being blacklisted i need to pay 1/3 from the amount which is i cannot afford. According to the staff my debts should be settle around the year of 2017. If I fail to settle the debts within this period they will bring the case to court. And the guarantors will be blacklisted and they will have bad reputation that will affect their position as a gov servants. Is it true?

The study loans was made in year 99'-20'. I was thinking to increase the payment within next year as the economy are very bad now. But I was upsad n worried my guarantors will be called to courts. Anybody can advice me? Thank you for your time n kind attention.

It would be expensive to bring a 5K debt to court.

And the guarantors will be blacklisted and they will have bad reputation that will affect their position as a gov servants.

IF you do not continue to pay, the blacklisting is in Mara only. They may not be able to be Guarantor for other deserving students or even their own children (if any). No effects on their position as govn servants.

Possible, but unlikely, if you restructure your repayment officially.

Having read the above and understooded, does not give you the liberty to default on a long term basis.
U shld be above 33-F (Males are less concerned) and have own young family which financially can be very tight now.
Write hitam putih to Mara and get written reply for the restructuring.

Your own blacklisting in Mara could only be Ban on Overseas Travel which can be appeal easily.

- yup n its scared me if they do. Meaning i  have to pay more for the courts expenses right.

- I made a promise to myself to settle the debts though its gonna take a some times to settle.

- I made restructure agreement before but due to financial prob was unable to follow. Then last year I tried again ti restructure but according to the officer was unable to restructure again as the balance that time was 7k+.
- the officer didnt told me that their had restructure the payment until recently I spoke with other officer who incharged with my case. That my debts should be settle by the year 2017 as the restructure last year. When i checked the online balance, no restructure scheduled. So i was confused there is a timeframe payment that i didnt know about..

Btw, what is the meaning behind bolongngenge. I google but no results.

Do as follows

Based on your Case.

1. Get email of the officer in charge of your file.
2. Make a proposal and email them.
3. Chase for official reply
4. After got any reply it means there is contact, there is communication.
5. Later pay according to your means, say maybe RM100/month
6. If really tight, pay RM100 every alternate month
7. Trust me they will not sue you if you keep in contact with them. For study loans, the Judge will throw their case if any crazy lawyers wants to file suit cuz of earning lawyers fees.

-been away from hometown for many years, forgotten the meaning just that I remembered it was in native sabah language.

- how to draft the proposal? any sample? been so long didnt do the official writing. I'm kinds lost here. Sorry.

- been paying 100/months so far for 12months already. I even asked the officer even though i have been paying monthly now you still gonna bring it to court and then she say yes. Because my debts should have been settled.

- i was hoping so much it doesn't need to be heard in courts.
- my cc defaulted for 5years now
- our car loans the monthly installment need to settle by next year as it was supposed to settle by months of may. Warning letter already receive last year.
- 😥life really though huh..

Legally correct but for 5K balance and it is Study Loan?
And you have been paying for the last 12 months?

Q's.
1. Who initiated the contact? Mara or You?
2. Did Mara contacted your Guarantors, by phone or in writing?

You should pay attention to these potential issues..
- my cc defaulted for 5years now 
- our car loans the monthly installment need to settle by next year as it was supposed to settle by months of may. Warning letter already receive last year. 


3. How much is the credit card default? Wait one more year and then apply the 6 years Limitation Act to set aside any lawsuit from the bank. Do not contact the bank or answer any bill collectors phone calls. (Any documented correspondence with bank is deemed admission of DEBT and set back the timeline for the 6 years Limitation Act.

4. Are you a Sabahan Muslim (need not reply)

5. Is your car under your name? Any property under joint names/loans?

Just as I have assessed that  Guarantor issue is not the main thing.
Study about debts litigation in this section of the forum and you will "more okay".

- they handed the case to the agent last year n was unable to contact me, so they contacted n manage threaten to guarantors i guess. Saying they have to attend court for the said debts. My guarantor contacted me regarding this n asked me to pay the debts as soon as possible, if i was able to. Within this year my guarantor will receive msg via WhatsApp i think, a reminder about the payment. I was wondering why they keep on receiving those messages since i am paying. So i contacted the officer via phone.

- i havent contacted them neither responding those collector calls. Been hibernating my fon on day times. The limit was 6k but i guess its rising like mountain by now.

- i was the guarantor. Still struggling to settle it asap.

I just happen to remember after defaulted few months the cc officer or bill collector(not so sure) called up n i happen to answered the call. Which mean the clock was reset is it jeff005? The last payment i remembered somewhere in nov-dec 11'. The called was somewhere in april-may 12'.

The calls you received at that point of time are standard calls. Now careful.

I can understand your feelings. When I first defaulted, for 2 years i read 2 newspapers everyday looking at the bkcy section only.
For 14 years I waited for them to bankrupt me..!!
Still no news.. honestly I wasted my time "running" and "hiding"..
I should have confronted the issue head-on with AK-47 machine gun 10 years ago.

If you are not in sales and marketing career, change yr number and use somebody name to register a new line.

But the extent of your debts is not declared out yet in this thread.
Nothing to worry about. Just change some dates. All financial debts.
Bill collectors cannot locate you thru Lawyerment.

For starters, study the below analysis. Take note it can only 90% accurate.

Your last payment in dec 2011. so by today dec 2016 should be around 26K.
The bank may take come action by next year so as not to breach the Limitation Period.
Foreign banks are more likely to sue first.
Local banks accumulate the high interests to max then file suit.
Assessed your own situation and take pro-active actions.

Thanks a lot. Yes luckily i found this forum it really does help.

I was scared that they gonna search the ic no as the bnm request to change the atm card by end of 2016 if not mistaken. As i had change my ic addressed due to change of state.

I guess 2017 gonna be real tough on me as mara, cc n car loan are on hot list. I staying in sarawak now.

The CC n the car loan are the same bank the C***. So guess they will take action by then. What should i do then? Just wait for the letter or how?

Was thinking permanently off my number but the mara need to be in touch right. Should i just wait for them to bcrupt me or how? As i am no longer working or intend to open any business in the future.

There so many things in my mind now, little bit disturb by many thing back in hometown+the debts problems..Kinda lost too.
