I happened to owe a bank credit card at RM3,000 in 2006. I managed to settle RM1500, and only had balance at RM1500 in Oct 2006 after they served me a notice. But since then until now, I didn't pay any single cents for the balance, as I have been suffering from depressions & not be able to work (only part time). Nor did I receive any calls or letters from this bank since then (until two months ago).
I have been receiving calls from this bank since last 2 months (they managed to track my number from my BR1M application form), and urged & forced me to settle the debt, which I do not know how much they have accumulated, as I simply ignored all their calls & SMS. Every time the phone rings, the numbers shown are either 03-xxxxxxxx, or UNKNOWN, then followed by an SMS (with a handphone no. & 03- XXXXXXX, urgently asking me to call back), and the person who SMS me was a lady, claiming that she is the Officer from XXX Bank Legal Department.
Frankly speaking, I am not in the position of pay anything at the moment, as my financial situation is still bad.
One of their final SMS sent yesterday, stated (written in quite broken & bad grammar English) that, they will freeze my other bank accounts, if I don't settle the debt, and will come to my house to pay me a visit. I am very depressed & worried at the moment, because I really do not know what to do, or whether I should answer their calls.
My main concerns an questions are:
1. After all these years (since 2006 until now), as I understand from 6 years Limitation Act, isn't my debt considered lapsed, since I didn't pay a single cent of it? Am I applicable under statute of limitations for this debt?
2. If the calls/SMS are truly & directly from the bank, and not the debt collectors or legal department officers, can the bank really obtain the judgement from the court and freeze my other bank accounts, which are debt-free?
3. If they happen to track my house address, and come to my house, can they do anything with my house belongings?
