Agent Fee: Who is supposed to pay, owner or tenant?

I would like to know why in Penang (or is there other states too?) tenants are asked to pay 50% of agent fee together with the 50% by owner instead of 100% by owner as in other parts of Malaysia. Is this legal? I thought every states should follow the same rules of property buying/renting in Malaysia.

There is no rule.
Whoever promised to pay, pay lah.
If tenant did not promise to pay 50%, he cannot be forced to pay 50%.

Usually the Owner and the Tenant has executed an agreement whereby the Owner has agreed to pay the Estate Agent a certain percentage of agent fee/commission. In your case, i believed such arrangement is for the convenience of the Owner and Estate Agent. All individual is free to enter into contract except if the nature of the contact is illegal and etc. I believed there is no issue and it is happening throughout Malaysia.
