Twenty years ago I became a guarantor for a personal computer loan (RM 5,000) from XXX. I have been receiving letter from XXX or its agent about the loan being unpaid. I already informed them about the person that owe them money. They have the person's phone number, home and office address. The person is still there and still using the same phone number. A few days ago I received a call from person claiming from XXX saying that the person that take the loan refused to cooperate. He said that he will issue a summon to the loan defaulter and because of that the guarantor is also being sued for RM 5,000.

My issue is XXX knows where the person is and able to contact him. That person has a good job. Simply by refusing to pay, XXX is going after the guarantor also. Can't they issue a summon to the person alone and use legal mean to recover the loan.

I know he can pay and the amount is not that big. Big question is, can XXX go after the guarantor without going full legal on the loan defaulter?

All this info you give is useless because the borrower don't want to pay.
When borrower don't want to pay, of course guarantor have to pay.
If not, then what is the use of a guarantor?
